Hi,
Would appreciate a bit of advice please. I am already sitting on 8 penalty points, i know far too many. Yesterday i was travelling on the A30 in Cornwall and noticed a Scamera van about 1Km away, I was only going about 80 - 81mph however when i saw him a slowed down to 60 ish. Its a 70mph road.
If the invevitable happens and i get an NIP how do i fight it? What are my options? Also is it after 3 years that points do not count towards a ban under "totting up"?
It was a sunny day, light traffic good condition car, alert driver (i saw the scamera didnt i) it seems very unfair to target drivers in this way.

An indicated 80-81 is probably 75-77 in real terms and, as such, should be below their enforcement threshold.
If it transpires that you were pinged over their threshold then low 80's would still qualify for a CoFP and you would have another 3 points to add to your 8 (unless you fought the case and won, of course
). Note that 12 points are required for consideration of a 'totting' ban..
Either way, if you are the RK then you will find out whether you've been scammed or not in the next fortnight (NIP must be served on RK within 14 days)..
For totting purposes, its the points you had at the time of the offence that counts.
Points are valid for three years, must remain on your licence for 4 and are declarable to insurance companies for 5.
