I have to report that Cptsideways has been liasing with the local 's the last few days, "the" local scrote (we thankfully don't have many round here) was witnessed jumping over the bonnet, roof & boot of one my cars over the weekend whilst I was away in Ireland.

Thankfully a local resident witnessed it, reported it, gave a description etc to plod. I've since seen the damage consisting of 3 dents & some scratches, have given a statement to the damage etc.

Police have a suspect & will be arresting the little bugger tomorrow & he and his parents will be taking a trip to the station Plod have informed they have sufficient evidnece for a conviction & will push for court appearance. From what I gather he's in the 14+ age range.

This was luckily only my daily runabout, though a rather mint 205 GT. Damage amounts to about £600 3 panels damaged. Only insured TPFT so whats the deal with recompense? Apparently I can only get compensation if it goes to court, if he gets a FPN & £80 fine I get nowt

Thought about offering the parents the option to buy the car at a slightly inflated price in exchange for not pursuing it, but it depends what the result of the interview is....

Anyone have any experience of ASBO's.......

When this happend to me, and I caught one of the 4 kids that damaged my car, the Police passed on my mobile number to one of the parents that offered to pay for repairs if I drop the prosecution. I said I would if each of the parents paid an equal share (stupid thought I had that if they offended together, they should be punished together). Anyway, the other parents did not agree, I did not get any money, and all the kids got off scott free...

After the criminal case where the guilt has been proven, you can also file a civil case to sue for damages.

This would be for the damage done to your vehicle and any other out of pocket costs. To do this you would need to first write to the defendant, the scrote, or in this case his parents and explain the extent of the damage and ask politely that they cover the costs of the repairs. Ask politely for a response within seven days.

If you get no response to this, reiterate the same as the above but warn that after guilt has been proven you intent to sue for the damage caused and when you win the case they will also be liable for your court costs. Ask politely for a response within seven days.

If you still do not have a positive response reinterate all of the above points and include the statement 'Final warning of intended legal action' and state that legal proceedings will commence without further warning in seven days.

From these letters you can show any court you have done everything you possibly can to avoid legal action and when you win the case they will aslo have to cover the filing fee which is about £60 off the top of my head. Even if they dont turn up you win the case and a CCJ is filed against their name. If they still dont pay you can employ the courts bailiffs to recover the money by whatever means necessary.

Hope this helps! The claim can be started at moneyclaimonline which is the online version of the way to start small claims proceedings. The forms take about 20 minutes to fill out.

I'd be throwing a few bricks through the parents' windows .. unless they're in coucil housing in which case it'd only be your own taxes paying for the repairs. Have they got a car you can inflict the same damage on? eye for an eye and all that ..

sensible hat on : the letter approach does sound much better

As JustineNP1 points out, a criminal conviction tends to lend a nice amount of weight to a civil case. There is an act which permits this to be used in court.

SO Sue the little feckers parents. Get a CCJ, send in the Bailiffs to take away scrotes TV and Playstation......

Is the civil case against the 14 year old or the parents? If the former, then you are not likely to get your money.

I would be interested to know whether that is the case. Is the parent financially liable for damage by the child?

If they can mount a criminal damage case suggest that it may go away if the car is made good.

When someone damaged our Window, the Police Officer told us they wouldn't press charges as they had agreed with scrote to pay for the damaged window......

Perhaps this is a new Justice thing?

In a way, you can expect the offspring of parents with no moral fibre to behave in the way they do.
