Hi Guys

I had a NIP come through about 2 months ago, for a speeding offence in March 06. Now I now the 14 day rule but this was my wifes company car so I just replied and let it slide. I have not heard a thing now for a month - do you think this is just been dropped now given it is 6 months since I got caught and I was only doing 84 in a 70? Anyone ever had one just "dropped" and never heard from again?

Presume SWMBO's employers are the Reg keeper of the vehicle?

If so then before the last post on 20th March 2006 they received a Notice of Intended Prosecution together with a Form under S 172 RTA 88 to name the driver?

Did they name SHMBO and did she get the 172 Form and did you put yourself down as driver, sign and return?

If so then unless you have 9 horrible marks on your Licence, accrued in the past 3 years, then you should have received a Conditional Offer - pay £60 and get 3 horrible marks on the Licence. If you have the 9 marks then it will be a Court case in which the wheels of justice can grind exceedingly slow.

But they have 6 months from 6.3.2006 to lay an information - a charge made before a Justice to the effect that some person has or is suspected of having committed an offence (a preliminary step towards obtaining a summons)- regarding the speeding and providing they have done this then a summons cam be taken out and served after the limitation on proceedings have expired.

Could be that a visit from the Postie is imminent or that on receipt of your reply they have checked their file and found they do not have the necessary evidence to proceed and have dropped the matter. You can cross your fingers, do nothing and hope the later, or you can contact the issuer of the ticket to see what the position is.
