Hi
Looks like i have had my car cloned - got a summons for a prosecution yesterday for a speeding offence 53 in a 30 in a place I have never been and I can prove it wasn't me driving. Does anyone have any experience on how to deal with this matter with the police and the courts?
The car in question is currently for sale - so I rekon some scrotes have had the plates made up - I have requested the photo from the police who do say its a dark blue golf.
The police have also said that it happened on a different day and time to the letter - either they have made a mistake on the letter or im about to recieve hundreds of these through the post.

Hiya
First off report it as a crime to your local plod, get a crime ref number, ask to have the reg plate tagged for ANPR. In which case carry some docs on you for the next month or two.
My wifes Rover was cloned, local plod said they were getting multiple cases each week & we live in the boonies!. He said its important to register the crime number & log your details "in case" the cloner uses the car for an armed robbery,
In which case you might just get a wake up call at 3am by some armed officers
DVLA's response was quite frankly laughable, they have no system in place to counter it, at all!!!!, they advise that the latest number plate laws are countering this crime, yeah right & that police are using new ANPR systems to check on cars on the road
no-one's told them it does'nt work on unreported cloned plates yet. They will sell you a new number for £26 if you really need to
Alternatively when plod come round just make a note of their number plate & get some copies made up from fancy plates & use those numbers till they fix the problem (which they won't cos they can't), it would appear to be the easiest way to get round the problem

Just found out its twice 12/09/06 + 13/09/06 I have to take a photo of the back of the car send it off with a letter from my boss stating I was at work during the alleged offence and print off emails which I have sent during those times. They have flagged up the car on the police database so no doubt I will get pulled over a couple of times until this matter gets resolved

So they want you to prove your innocence! They want you to send them potentially sensitive documents and which are inconclusive anyway!
This is rubbish. Report the crime of cloning, ask for the proof it was you & your car involved in the offences and provide them with details of your boss who they can talk to if THEY wish to investigate. If the police then decide to proceed I would claim victimisation.
When did it become up to the accused to prove their innocence.
CPS should chuck it out anyway.

Presumeably this gives you immunity from all camera related speed traps?
Naughty naughty! Interesting idea though!
....Until you get caught on one that shows your face and you lose all credibility and face prosecution for the other offences and perverting the course of justice!
Thanks for all your replies - I will keep you posted as to the outcome - I will prob get woken up at 3am with armed police as it will be just my luck that the cloned car will be used as a getaway

Indeed, we have had two of our drivers get hauled out of their scratchers in the early hours because of cloned vehicles used by armed blaggers.
My brother's company car was cloned a few years ago. He was on holiday at the time, in the Dominican Republic, when the first one was picked up. First (of 5) was from Cambrigshire, about 200 miles away from home. Only way to see the photo's was to travel to Cambridge, not exactly convenient.
He sent scan's of the entry and exit stamps in his passport, they weren't interested. Said, if you weren't driving, tell us who was,, or we'll prosecute you under section 172(?) At one time I was in the frame as the driver as I had his spare set of keys, even thought the car was in secure parking at the airport.
Second was in Liverpool, closer to home, but he had a receipt from a supermarket for 15 minutes after the pic's were taken. Again, not interested (the time's wrong on the supermarket till). He went to see these photo's, even he half believed it was his car (a fairly non-descript Silver Honda Accord) Fortunately there were some marks on the bumper, which they tried to pass off as marks on the film. However they were in the same place on both pic's, so they finally accepted it was cloned. Marker put on the PNC, although they started with "cloning doesn't happen". He was never stopped, but finally, after another 3 speeding's in Cambridgshire and Warwickshire and a parking ticket in Oxford, all while working in Belfast, a scrote was stopped by a police car. (amazing, they exist!) Allegedly they even gave my brother's name and employer.
No apology from police, no admittance from Cambridgshire or Warwickshire that they were wrong, only communication from Cambridgeshire was telling him that no further action would be taken and to drive more carefully in Cambridgshire! (Cheeky feckwits)
All in all, a nightmare for him, nearly lost his job (because he's a service engineer, and needs 2 drive, and would have hit 12 points before they accepted there was a cloned plate), had to take a number of days off work to try and sort it out, and ended up changing his reg plate.
Sorry to be so negative, but that, and seeing someone arrested, charged and convicted of Drunk and disorderly because they had the cheek to cross a road, and hearing the completely false evidence given by a policeman in court, completely dissolved any respect or belief I once had in law enforcement in the country.

Update
I had to send off proof I was at work - letter from manager, emails etc etc and photos of the car taken from the back BEFORE they would send my the proof they have of the speeding offense. So after doing all of the above looks like they are dropping the case because the car in question is a blue golf with different style plates and doesn't have dealer stickers in the window. RESULT

Been going on for years. My old man started getting parking tickets for offences in Bedfordshire. After jumping through many hoops, including getting signed statements from his boss and colleagues, they let the matter drop.
ANPR wouldn't have been a problem for him though, it wasn't invented. This was circa 1985.
As it goes, he never went to Bedfordshire in his life, but might have been trickier if it had been more local ?
