In a situation where a bankers draft is made out to a person. Is it possible for that person to gain access to those funds without presenting the bankers draft, as long as he knows the branch the draft was drawn and the draft is drawn out to him?

My brother is getting messed about by a ebay bloke in regards a car purchase and I am starting to think he is being conned. The deal was set to take place on wednesday and my brother had a draft drawn on that day ready and took a day off. He also informed the seller, of the bank where he drew the draft as the seller wanted to verify it. Now it is saturday and the deal still hasnt been done as the seller keeps giving excuses why he can't do the deal yet, which is making me a bit suspicious.

Another issue is my brother had a HPI check done on the car on the wednesday, is that valid now or does another one have to be carried out?

No, the seller should not be able to get the money without the draft.

The seller will probably want to verify the fact the the draft was issued and not a dud on the (mistaken) belief that drafts are cash, which they are not. Drafts still have to clear "the system" before being creditted. There are sme well documented stories, here on PH, where people have been paid by drafts only to be told they are dud and have consequently lost their P&J.

Not wanting to scare monger, but worst case scenario here is that if seller is a fraudster, he could be making up a fake draft from the details you gave for some unscrupulous means. But that shouldn't really affect you as the draft should be spotted as a fake before they take money from your account. I feel this is highly unlikely though.

If you think the seller is scamming you, then just cancel the draft and walk away from the deal. So what if you get a neg rating from ebay.
