jus wanna know how my friend stands, he was pulled by an unmarked car in notts on the M1 yesterday doing 96mph he is on 9points at the moment so this will take him to 12! does this mean a ban? we have debated this at great length. this was his own fault only excuse to the police was im running late! is it worth appealing for calibration or something of the like?
regards
matt

Anything over 95mph will be more than 3 points, and more than likely be 5 or 6 points, but either way your friend will be facing a ban under totting up proceess.

Think this is what he'll be needing. Not a lot of sympathy - I know it's only an arbitrary number, and not even a very big one, but with 9 points already???

Was it on the M1 itself or nearby?

Your mate is a mong for doing that speed with 9 points. Disregarding for a moment the morality of speeding penalties and whether or not his speed was safe, hes taking a rather stupid risk.

Oops!

Stupid thing is that 96mph on that stretch at 3pm yesterday would have seen him sat in lane 1 driving like a granny! There were plenty of cars (passing me, obviously) doing in the region of 1-1.1 leptons. M42 was just the same.

His only hope would probaby be to argue he needs his licence in court. He should contact a solictor to put together mitigation as to why his licence is important etc etc.

Got to be honest though I dont like the idea of him trying to get off on a technicality as in reality he was driving that fast and no doubt faster at some point and he would have been followed for a period of time.

I always take the view that you have to assume anything behind you that is close to your speed is an un-marked car until your sure its not.

Most stand out if you look hard enough. Few extra ariels, two rear view mirrors, normaly two guys in uniform in it.

He is a bit silly though with nine points on his licence to be doing anything other than speed limit and less. You need a safety cushion!

If he drives for a living and has a wife / dependents who would be adversely affected by him losing his license then that's a possibility - I don't *think* that losing his job would matter because it was him at fault and he who is effectively punished (harshly) by banning him, at least I think thats the logic behind the discretionary ban! Somebody else will be along shortly to confirm / refute this!
