Bit of a long story, but my mate had a loft conversion built by a local builder. Part of that was to install a Velux loft window, which was done. Also, my mate had the roof relaid by a roofer. Now my mate asked the builder if he would let the roofer install the window as the works were done close to one-another, but the builder said it was allright as he could do it.

The end result is that he botched the window (the loft conversion is ok though), and it lets water leak through. My mate had the roofer back around, who discovered that the builder had broken some ridge tiles and laid the flashing under the window - result, water runs under the flashing into the house. The builder wanted to fix this, and sent a lad around with expanding foam - which my mate refused. You can't fix a roof with expanding foam!

So my mate had the original roofer repair the job (whose work was immaculate), and paid him. Now hes taking the builder to court.

Last night, gloss paint mysteriously found its way all over my mate's house and car. They've got most of it off the car so thats ok. The police have been informed. I've told my mate to ignore it, and continue with the court case.

'My mate' isn't me btw - it really is my mate.

Seriously, if this happened to you, what would you do?

Keep the moral highground by not retaliating, buy a webcam and use it to cover the car/front of house, and keep using word of mouth to relay the story far and wide.

The court case has been and gone. 2 weeks ago. My mate won, with full costs. The builder threw the cheque in his face.

Its obviously the builder, my mate isn't the sort to go upsetting people, never been in trouble before, hard working. This is a nice area as well.

An officer has already been round, another one is going tonight to take a statement. What rights does my mate have, can he insist somebody takes evidence (the paint) or something?

This really is a sad state of affairs when dodgy sods like this resort to such actions when all people pay for and expect is a decent standard of workmanship.

It would seem obvious that this is him but, the problem is proving it.

Even if the forensic team came around I very much doubt that there would be any way of pinning them to the job....

Unless of course they happened to step in the paint, leave a footprint which could be matched to their boots, which may of course have the same paint on. Not conclusive evidence but enough to build a case on.

I think the reality of this case is that the scum guy now thinks he had got his own back and will now leave the situation. Similarly the police will probably find that after logging the situation that they do not have evidence to continue.

...and this will all be forgotton.

Paint will be from wholesaler or some outlet where you could not trace to prime suspect here.

No matter .. what come around .. .it go around und whehter or not truth will out on this one.. comeuppance will occur at some time. Maybe every Gatso in area will ping him....

The judgement against will also count against further work... there ist record of the court case. Make sure by word of mouth that people know of the unfavourable judgement against - proves he ist unreliable und botches job. Will hit his pocket.... never recommend him. Show photos of the botched job.

We do go off personal recommendation before letting folk loose on possession more valued than the possessions on wheels und which give us speedy thrills

We have slight other problem.. home ist listed building. We have to abide by some rules as result to preserve its specialness - und we do not mind doing so as by preserving this specialness .... we keep its appearance und maintain a culture as well as preserve the capital asset. We thus very choosy as to whom we employ to do any job here. und we make plain that "not up to standard expected.. we pay 90% und final 10% when satisfied. We draw up this contract before they start. Most know when they are licked by mad und wild felines hehe

Well the builder has a CCJ on his record now, so hes going to be ttted for any credit applications.

I tend to take the long view over these things, if you know what I mean

Hate to be the bearer of bad news but if you pay a judgement by the court within 30 days you can apply to the court to get a notice of resolution or something like that and you will never get a CCJ on your record.

i always think that tempting as it is retaliation will lead to a vicious cycle of trying to get one up on each other. its likely police wont do anything but if this is the only incident id be tempted to let it go and be the grown up. if it happens again then get the baseball bat to his car/van/house/face or all four.

Justinp1 is right on this- payment within 30 days and you can have a judgement removed, it will never show on a credit report.

If the builder is part of any recognised trade organisation then it might be worth mentioning to them that he's cack. What part of the country did this occur in? I certainly wouldn't consider retaliating, although I think that your mate should certainly push the issue with the police, it's pretty obviously a retaliation thing on the part of the builder.

I'd have the local paper do a little writeup on the paint vandalism.

I's also inform them that I had recently won a claim against a builder in court for shoddy workmanship.

I'd hope that the two articles were on the same page. Newspapers like that kind of thing.
