Professional driver does his usual checks before starting his journey and finds a fault, calls the fitter but it can't be fixed, no way, they give him the next trailor and off he goes.
Then he finds out they told another driver to take the defective trailor, the other driver takes it because he as only just started with the firm and does want to rock the boat.

Its illegal, its a (very)big firm, its not me.

What should he do.

Under no circumstances should he drive with a defective trailer.
Have you ever seen the result of an artic going out of control?
The firm you mention is likely to be one of two that I know get away with this on a regular basis and don't give a toss because the directors with the colossal salaries are not the ones who are risking their lives and licences.
Tell him to find another job and report the firm.

Surely the directors are risking jail under H&S?

A report to VOSA is also in order and might result in a more focussed response.

You know me, slightest excuse to go off at a tangent but....

Sorting out and getting rid of this sort of rubbish in the road transport industry was the reason Mary Williams founded Brake. All power to her elbow for that and more. Some of what Brake campaign for makes sense and looked at objectively is not a lot different from opinions that many PH'ers express, just that in some areas Brake have gone way way off plot in my very honest opinion.

Same can be said for RoSPA which is why I resigned.

Nothing in this post should be considered or is intended to be defamatory, derogatory, or in any other way detrimental to the work that the mentioned organisations undertake. If Ted or the mods wish to remove part or all of the post in the light of the seriously small minded attitudes shown by some members of those organisations then so be it.

I would let your local Roads Policing Dept know as well as VOSA. Offences under con and use regulations which all include use, cause or permit in them. I.e Guilty knowledge of the defect on the unit by the trnasport manager and the unit is still used he is guilty of the offence.

I know truck drivers are not highly thought of by some people but if a trucker sticks to the letter of the law surely thats a good thing especially for all the other road users.

Rules are there for a reason and if the brakes on a truck fail then watch out anybody in its way, the chances are you will die and the trucker will feel very sorry, not much comfort for the grieving family is it?.

Thanks again, I'm sure I'm doing the right thing.

Thank you for taking action.

It is important to stand up and be counted on issues of safety. Not enough people take the trouble.

I've had similar.

Whilst doing agency driving (a good few years back) for a weel known parcel company (They were regularly refferred to by the agency drivers as RightState) I was on a trunk job and during vehicle inspection I found several defects and refused to take the trailor out and booked is as OTR.
The transport manager went nuts.
I was given another trailor and the warehouse had to unload the original trailor and reload the replacement.
Off I went to do my drops - as I was returning to the depot I saw another unit pulling the trailor (the trailor was easily recognised by some distictive high level damage) It was being driven by another agency driver rolleyes

I never drove for them again (I refused to go back)and they got a un-expected visit from the Ministry (rumour had it they got turned over big style)

Use/Cause/Permit.

These are offences charged with the principle offnce regarding whatever the defect was.

The driver uses
The company use as its on their business
The transport manager causes.

3 individual summons for one offence!
