Hi all

Anybody out there got views on the "financial" implications of the 2 penalty options for 40 over the limit on a dual carriageway:

6 points and up to £1000 fine Vs Ban of up to 56 days

If you don't have to drive day to day and a ban doesn't impact you for the ban period, how big an insurance price hike are you likely to see for a short speeding ban versus 6 points???

And is there anyway to try and "steer" a judge towards one or the other ??

Yes. When you are giving evidence tell the court that the police officer who clocked you was obviously incompetant as you were doing quite a bit faster than when he said. About 110-120 should do it. That will get you the ban.

If you would prefer the points, you need to offer hardship reasons why the lives of other people (not you) would be affected by the ban. For example taking your disabled sister swimming.

Seriously though, there has been a recent trend to not giving bans and giving out the points as this often leaves someone on 9+ points for a couple of years which I think they think is more of a deterrent to not speed again than if after the ban they were back to 3 points again.

My housemate got done for 107 on the m'way earlier in the year. Checked a few online insurers and rang up some of the Jap specialists too, nobody seemed to load the premium differently for a short ban or 6 points. You'll get the fine either way

She ended up getting banned (for 28 days iirc), best result for her as otherwise she'd have been on 9 points and so at risk of the long ban under totting up if she got caught again.

Yes, but...
Looking for bike quotes, came across an interesting question, along the lines of Speeding convictions in the last five years, and disqualifications in the last eleven..yikes

Isn't it that certain types of disqualifications need to be disclosed for 11 years (dangerous driving and Drink driving maybe?)

re the big fine - the way I read it it is either fine, points and court costs, or ban and court costs.

Nope you definitely get fined if you get banned as well as having to pay costs.

ETA: Although the theoretical maximum fine is something silly (£1500 rings a bell) its unlikely to be anywhere near that. Was ~£200 for my housemate.
