Hi everyone, advice needed, got pulled over last night on the motorway by unmarked trafpol they followed for a couple miles, then pulled me over for speeding they did the usual checks my car is all legal they even knew how many points I had, told them I was late for work etc etc I apologised etc it was approx 10pm light traffic speed clocked at max 93 mph after a bit of a chat, which I believed was a verbal NIP they said they had no tickets confused and they will write to let me know the outcome. Have spoken to a few people today and they felt this was a bit strange. So I thought I would open it up to the PH masses for their thoughts.

Not strange really.
Sounds like you've been NIP'd.
Wait to see if you get a summons.

Thanks for the quick response Vonhosen, so it`s normal for Trafpol to not issue a ticket or producer on the spot? How long do you need to wait for?, is it 14 days or 6 months?
or is there a possibility they might forget all about it, not knowing is worse than the fine, According to the ACPO guidlines i should get a Fixed penalty, but could they summon to court for 93mph?

Hey Torbay85,

Can you help us with some 'intel'?
What stretch of motorway?
What kind of car were they in?

Whether they issue a ticket or summons is a matter for them. The ACPO guidelines will advise that the *minimum* action to be taken at 96mph (in a 70) is summons, but officers can take that action before the advice threshold is reached both legally & legitimately.

If you've had the verbal NIP, then they have 6 months in which to lay information before the court & start proceedings against you.

If summons is the 'minimum' WTH is the maximum? Shooting?

That sounds right, but the OP said MAX 93mph - which could potentially just be a NIP / fixed penalty offer. Equally the BiB might just forget...maybe?

You havent been convicted of anything so theres nothng to tell your insurers. Of cours eshopuld you be charged and prosecuted at alater dat you would need to advise them to stay legally insured

Don't the insurance companies also ask if any convictions are pending?

If you haven't received a FPN or summons, then there aren't any proceedings pending. If you do receive those then inform them.

Erm...correct me if I'm wrong but if you've been given no producer or NIP then you won't actually hear anything as there's no officers statement handed to you (ie written proof) that you been stopped at all. Looks like you got away lightly!

So a recently received NIP doesn't have to be declared?

A NIP states in effect, that there is an allegation & that is being investigated & consideration given as to whether you should be prosecuted, not that at this stage you are being prosecuted (that decision hasn't been made yet).

You would have to read very carefully what the insurance company are asking & answer truthfully their questions.

A FPN, a summons or a charge, means action is actively being taken against you.

Yet another shameful waste of our resourses enforcing a bad arbitrary law whose only merit is that it's easy to enforce.

The sooner we lose these obscene and oppressive speed limits the better it will be for all.
