New laws on driving whilst using a mobile phone

I was listening to Virgin Radio at the weekend and heard the new adverts about the new rules for driving whilst using a hand-held mobile phone. Basically its 3 points and a fine if you are caught. But the implication from the advert is that you can be prosecuted for using ANY phone whilst driving.....

Just a quick question - it is for hand-held phones isnt it? Professionally fitted car kits with a holder is still legal isnt it?

Is our wonderful criminal justice system looking to ban these in the near future too?
