My son receved a parking ticket for parking in Bath Street, Bath. It has no yellow lines as to quote B&NES "Bath is a Heritage City and putting down yellow lines on this street would not fit in to the immage of Bath".

They point out that there are Clearway signs on each of the entry roads into Bath and they cover the heritage roads not bearing DYL's or SYL's.

When he asked to see the photographs taken by the Parking Warden he was told that B&NES do not do that.

Under PACE aren't they obligated to show the 'defendant' the photoigraphic evidence? Or doesn't PACE apply to Local Authority civilianised parking wardens and decriminalised yellow line offences? confused

Looks as if the area you mention is covered by a Traffic regulation Order for a 'Restricted Road' which can be granted in respect of areas of natural beauty. As such it is permitted to do away with the yellow lines. It does however have to be signed at the starting point either side and have plates at intervals indicating the restriction.

Bath I believe has elected to take care of its own parking matters taking enforcement away from local Police. By doing so they have decriminalised parking and ask such then PACE etc is out of the window.

Or else what?

There's no appeal to a magistrate, and the adjudicator is unlikely to need to see the letter of the law complied with.

You're rodgered, but I'd appeal anyway. The signage is bound to be deficient somewhere.

Interestingly a friend of mine appealed against a parking ticket in Somerset Street in Bath for parking in a Taxi Bay. The road markings no longer existed and there was no paint left on the road. The only indication was the small plate affixed to a street pole some distance away.

B&NES stated that the regulations that dictate the type/colour/dimensions/nature of the road markings were purely for information purposes only and not enforcable or required to prosecute for the offence.scratchchin

Whatever you do, pass the details to the Bath Chronicle - local press here has had a field day with corruption and malpractice in parking enforcement over the past few years.

I'm afraid this is absolutely correct. What many people don't realise is that the restricted road order in the centre of Bath also includes a blanket 20mph speed limit in the city centre. This apparently catches out lots of people - particularly in the tourist season.

yikesI don't often visit Bath, but I've never noticed any signs to that effect.

They are on all roads on entry to the city centre, but with no repeaters!

yikesI'm sure I wouldn't have missed them. I might have to go and have a look to see where I should have seen them (IYSWIM) when I was there last week. TBH with the gazillion other things to be checking for, and the usual road sign clutter I'm not that surprised.

As an aside, if a 30 zone has no repeaters but street lights, how are you meant to differentiate between that and the 20 zone? So... is it legally enforceable?

My advice for what it's worth, based on working there for 10 years. Don't drive in Bath. It is very un car friendly. Better to use one of the Park and Rides. I live nearby and wouldn't dream of driving anywhere near the city centre.

I love Bath. I come from the area originally, I spent most of my childhood in villages around and I moved back to the area just over three years ago after spending years globetrotting. It has the most ineffectual local administration on the planet and the city is dominated by nimbyism and petty small-mindedness. Which ruins it, because it is a stunning, stunning place in all other aspects.

Bath is run by bumbling old fools. Bristol is run by hateful communists.

Fair enough, the locals can express their views in the ballot box, none locals have no other voice except voting with feet.

There are a number of places that I will just not go unless ordered. North Wales is but one example.

Bath is a place that everyone should visit - it has the country's best HiFi and AV shop "Audience" on Broad Street.
