Hi,
I have recently been caught at 51 in a 40 zone, after visiting PEPIPOO the NIP wizard suggested returning the NIP unsigned and ignoring any further correspondence as I live in Scotland. However, it appears that the last time this has been used was in 2004.
Is this still a valid route to take or has there been some progression with regards to the law in this area? I do not want to roll over and take the points but nor do I want three points and a larger fine for failure to provide information. What to do?

Any help much appreciated.
Regards,
Ben

That's a really good question, and I want to know the answer too.

The fudge in the Francis -v- DPP case in the High Court closed the 'onsigned forms' loophole in England and Wales in 2005, by using PACE (Police And Criminal Evidence Act). But there's no PACE in Scotland...

I have won four cases in Scotland and one in England in the past twelve months without going to court.
All of them were by 20/20 Speedscope, and I am convinced the Fiscal will not risk a trial when the evidence is so flawed.
In three of these cases the camera operators were NOT police officers.
This would make the evidence fatally flawed, as corroboration is essential in Scottish courts for a conviction.
I am going to post the details of the English case when I get the time simply because I have literally never experienced anything like this in my entire life.
It was totally and utterly scandalous in terms of sheer incompetence, prejudice and blatant oppression from the CPS, the police involved, and worst of all, the camera partnership.
I can sum it all up in one word: Cumbria!
I will never again get involved in an English case, unless it is to defend myself.

Not so. The unsigned route is still being utilised north of the border..

i have in my hand, a NIP for a 20/20 where i am being cited as the driver at the time.

The offence was in Scotland, where i live.

I have ignored for the past 21 days, but yesterday got a reminder about the s172, stating that i risk a £1000 fine if i do not return the NIP.

However, it was a company vehicle (think of it like a pool car) where there could be any number of possible drivers at the time.

My company cited me as the driver as i am the person who was "responsible" for the car at the time (manager).

What to do? whatever i do, i need to do it today!

Visit www.pepipoo.com

However you have two sensible choices:
1. Name yourself - go unsigned
2. Name all possible drivers and let them sort or out. You have to request photos to help identify the driver etc
