I have just received a notice dated 06.03.07 for a speeding offence on the 29.12.06 (Cardiff safety camera van approaching M4 Toll Plaza, 60 mph in 50mph limit). I was driving a company car and the fleet management company received a notice of intended prosecution on the 8th Jan 07, replying with my personal details on the 10th Jan 07. It has taken almost 2 months for the authorities to send what I believe is a second notice of intended prosecution, asking for confirmation if I was the driver at the time of the offence and if not for the drivers details.

Does any one know where I stand, provided the registered keeper is notified within 14 days can they issue further NIP's which are non-time limited?

Has any one else had a similar experience?

The NIP to the registered keeper was within 14 days. As such the 'second' NIP has no time limit (unless you look at abuse of process although that would not aply in this circumstance).

The NIP time limit applies to the registered keeper. Any subsequent issue of NIP resulting from that original are not time limited in the same way. They are still limited by the statute of limitations for the offence (ie information has to be laid before the court within 6 months of the offence).

Whilst I agree with all the comments on here so far, it might still be worth popping over to the pepipoo site.

Don't believe all the hogwash about taking it on the chin, that is probably what you will have to do, but no harm in making a few enquiries is there?

OP has 28 days to respond. I'd have difficulty in remembering who was driving that long ago. Best take all the 28 days to try hard to do so.
