A friend (no, really!) has been working for a company for nine months and has passed probation etc. He's just been asked to fill out a form so they can check his license (even though he's been driving a company car since the start!). He's a little worried as a drink driving conviction appears on his license from 6 years a go. However, they have not asked to see his license, and as it has been over 5 years and is spent, will it show up on a check? This is a normal job, not army or police or anything. I told him not to worry, as surely a private company can't get ask to see spent convictions. Obviously his license is still endorsed for another 4 years. Are companies concerned about spent DD conviction? Especially as the company seem to be happy with his work, i doubt they'd let him go.

I think he's stuck with them on his licence for 11 years.....

Drink drive endorsements stay on the licence for 11 years from 'date of conviction'.

It's a tricky area and one where the RoO act is a little unhelpful. So long as he hasn't lied to them, hopefully it won't be a problem.

Oh. Is the conviction spent after 5 years? or is that also 11? Will a check with the dvla flag up any endorsements on the license, or just ones that are unspent?

shouldn't be an issue either way if the conviction is on the licence unless the company's insurer stipulates an increased premium for these type of offences in which case your mate might have to pony up some extra cash. Most company policies are blanket for all vehicles and approved drivers (employees&spouses with full driving licences - company i work for certainly is) so it shouldn't make a difference to him.

i know people with 11 points (last fine was 2 points and a £500 fine - good brief & lot of pleading meant magistrate went easy on points but heavy on the money) on their licence who are happily driving company cars with no extra cost etc.

prior offences are only a guide to prior behaviour.

The important thing is that he hasnt and doesnt lie about it.

If he does then he *will* be in trouble.

From an employment perspective what he did 5 years before he started the company is of no reference to his work now and couldnt be dismissed for this. It may be embarrassing for him, but really there is not much they can do.

Agreed. As long as he didn't fill in a form which said Full and Clean license, he is fine.

Most companies would want a copy of the drivers licence to validate the insurance cover.

That is true of all the companies I have worked for.

For the purposes of the Rehabilitation of Offenders Act the conviction is spent after 5 years (I'm assuming fined not imprisoned etc here), but the endorsement stays on the licence for 11 years & would show up on the DVLA record check.
