My wife got a nip in the post today (well I did but she was driving). The alleged offences are "Failing to report or stop from an accident - Road Traffic Act 1988 S.170(4)" and "Careless & Inconsiderate Driving - Road Traffic Act 1988 S.3". It happened saturday morning between 9 and 10 am which would have been when she was taking our daughter to a ballet lesson (9am to 9.45am) and states the road on which the lesson is held. She has no recollection of any accident or any incident such as getting in anyone's way or nudge parking at all. There are no marks on the car at all that weren't there before. Is this the standard letter you get if someone complains about your driving? Given that she has no recollection of any incident what's likely to happen next?

Thanks,

Mark

Without meaning to sound flippant, no. This is the letter you get when your vehicle has been involved in an accident and has not stopped at the scene.
I expect someone from the Police will contact you and explain the allegation and may interview your wife.
THis letter in itself does not mean that she will be prosecuted for anything.

Ok, thanks. I'll get her to contact the station.

My wife got one of these a year or so ago, she was definately at the place at the time but had no knowledge of any accident. We wrote to the police and said as much and never heard anything more about it.

Thanks very much for that. Hopefully this will go the same way.

Jesus, all it turned our to be was that she grazed someone leaving the car park but didn't notice so didn't stop. She asked around when she went today, found the woman who's car she'd scraped and we sorted it out (or will do when they get a quote). They apparently went to the police and reported it but told them they didn't want to take it any further. The police then pointed out that as it's been reported they have to act on it.

What's likely to happen now as far as the offences go given we now know what happened, owned up and offered to make amends?

Thanks,

Mark

Edited to add: Sorry, it sounds like I've trivialised what my wife did and inferred it didn't matter. It does, obviously, and we'll set the damage right. What I meant by my "Jesus..." comment was that I was relieved it was something relatively trivial... I had visions of my wife reversing over some kid or something

If your wife maintains that she was not aware of scraping anybody, then she has not committed an offence of 'failig to report..'.

That's what happened when someone hit my car then drove off, the BiB went round and had a chat with the other driver about his driving, and passed over my details for him to contact me to fix the damage.

All sorted within a week

Just to follow this up. We were able to find out who we were supposed to have had an accident with. Turns out my wife dragged the back bumper of her car over the front bumper of another. We are in the process of paying for the damage (voluntarily) she caused but haven't heard anything from the police since I sent the NIP back.

Cheers,

Mark
