Wife run off the road
Discussion
Hello all, just wanted to run this past you.
I will keep the details ambiguous because I dont want to predjice any case or claim that may arise.
My wife was in her car overtaking a long line of trucks on a dual carriageway the other day when a big car comes bombing up behind her and sits on her bumper. As soon as she has cleared the trucks the driver undertakes her and obviously in a move to intimidate, pulls back out with the minimum of room.
My wife saw the car about to side swipe her so she hit he horn and brakes, she doesnt know if she hit him or not but went into a spin and flipped into some small trees.
She was trapped in the car for over an hour and the air ambulance was scrambled because of the exstensive damage to the car they thought she was very badly injured.
We saw the car being removed from the salvage place the other day and it was smashed beyond recognition.
My wife has a bad head wound and is suffering with all the usual drowsy, dizzy, forgetfullness, head achy, slow thinking symptoms of such an injury. She blacked out in the car and doesnt really know what happened beyond the details outlined above.
We are starting to get angry about the accident now, but we havnt spoken to the Police yet, they have yet to take a statement from her.
Anybody with experience of this kind of thing like to make any comments about what might happen next. Your comments are most welcome. Thanks.

Hopefully there will be witnesses.THey will have been interviewed.
Police will try and trace other vehicle and driver.Probably been doing so already.
Most important thing is for your wife to get well, and the Police will contact her, in due course.
Did the incident happen near where you live?
If it did, may be worth caling local nick and asking for officer dealing to contact you.
You have my sympathy.
What a horrible thing to happen.

The police will interview your wife when she is well enough to be seen. They will take an account of what she alleges happened. If the crash was serious enough, they may well ask for witnesses in the local press to come forward. You state that the road was heavily populated by goods vehicles at the time. An incident like this normally attracts a huge number of witnesses that are in the vicinity of the crash when it happens.some of those will inevitably wait there until the police/fire and ambulance service arrive. Some of those always leave their details so that police can contact them later.
If those who may have stopped at the scene to assist your wife in the first instance saw the conduct of the alleged aggressive motorist, then I expect they will corroborate that evidence with the investigating officer. I have never been to that sort of situation before when at least someone has volunteered that information about dangerous driving causing a collision at the time of attending the scene.
If your wife's car has received damage, the police MAY (although unlikely) take paint samples for analysis. This only usually happens in fatal non stop collisions because of the expense involved.
If you are lucky and the course of events are as you state in your post, someone who happened to be in the vicinity and saw the driving of the alleged other vehicle, may well have recorded a registration number.
The Police may check CCTV or speed detection cevices to see if prior to the collision, a vehicle matching the description given by your wife was indeed on or in the vicinity of that road at around that time.
I hope that helps.

Sounds awful mate. I wish your wife all the best and a speedy recovery.
Are the police aware there was another vehicle involved? I think it would be prudent to get them to take a statemnet asap. If your wifes vehicle did collide with the other vehicle mentioned there may be traces of paint etc on your wifes car.
Good luck and I hope it gets resolved soon.

Sorry Guys...
I should have added that the Police have 2 indipendent witness statements corroborating what happened. One of the Trcukers stopped and was holding my Wifes hand in the car.
We think the car that caused it, stopped and the Police have spoken to him.
The car is a complete write off...rear has disappered, the enging pay smashed to bits none of the doors open the roof is caved in, it looks like a fatal..... I dont know how she has effectively walked away from it, her arm is very heavily bruised an dthe head injury is worrying but no other major injuries

I would have thought there is no rush to interview your wife, until she feels up to it.
I really would try and make contact with the investigating officer though, if only for an update on the current situation, and for the benefit of your insurance claim.
Most forces websites can give you information about how to contact them after an accident.

Sounds to me like you have it covered, independant witnesses would have already put the police in the picture and I'd love to hear how the other car driver explains his actions, he might say you wife wouldn't move left, but then why did he move right after undertaking her?, obviously his only reason would be to overtake the car in the left lane(thats why your misses didn't move over to the left).
Good luck but I don't think you need it.

My comment would be from a different angle.
Yes you do want to seek compensation off the other driver's insurance. But don't get drawn too much in to that side, if you spend too much time telling lawyers and courts how dreadful it has been and how much you have suffered, you can end up making yourselves feel worse.
Getting on with the rest of your lives is more important than bitterness towards driver and seeking every last penny.
Which doesn't mean that if I came across the little
that nearly killed me that he wont get a

Sorry to hear. Did the police treat it as a crime scene (www.pistonheads.com/gassing/topic.asp?t=373364&f=10&h=0)? - Streaky
Thanks for the replies.
We havnt beenable to speak to the Police yet. The Officer looking after it hasnt been in touch and we chased him today but to no avail. I expect hes busy.
Regarding the comment about compensation, we arent really preoccupied with that as you rightly say it just makes us feel worse thinking about it and any compensation comes so long after the event that I think it probably has less meaning as a consequence. Surprisingly we arent even that angry with the driver YET, But I think that is because we have no name, no face and I havnt even seen his car to direct our anger towards. Although I did surprise myself at losing it a bit at a boy racer who was darting in and out traffic 2 days ago undertaking people,i admit I wound down my window and reminstrated, which I should nt have done. He was just a convenient conduit for my latant anger.
My original post was really just to get a feeling from anybody who may have experience about what might happen next, would My Wife have to go to court or how long we might have to wait to get the insurance sorted in terms of getting another car. Is the other driver even likely to get prosecuted! Who knows....

Sorry to hear about your wife. I hope she is on the mend and isn't over concerned about driving again.
Having been through several insurance claims, it normally takes a few months for the solicitors to sort stuff out and pay for the damage in teh case of a write off. One thing I would say is to never take their first offer.
Your anger at the boy racer undertaking was understandable though, if a little out of order, but hey if it stops another accident.......

This might be bad news on the insurance front, Because your wife didn't actually make contact with the other guy his insurance company are highly likely to defend him if he get taken to court for an offence relating to the accident, the logic being if he doesn't get found guilty of an offence then his insurance company will deny liability.
This happened to a friend of mine and he was the one that caused the accident, the police dropped the case at the second court date and when the other party tried to claim against him his insurance company said "no our client did nothing wrong".
Life can be cruel.

My friend was driving a Land Rover pulling a horse box, the road ahead curved to his left and he wanted to make a right turn just before the curve, he slowed down and started to make the turn when an Alfa Romeo appeared round the curve, he was going too fast to stop, he couldn't pass him on the right so the LR driver stopped, the AR driver tried to get round the left turn (to him, right turn to the LR driver).
He didn't hit the LR but did end up in ditch, it was a right off.
The LR driver was charged with DWCA and his insurance company said they would defend him, the first date came and the prosecution asked for an adjournment, at the second date they didn't produce any evidence, that was when the LR drivers insurance co told the AR driver they wern't going to pay out.
This story was told to me by the LR driver so he may well have not bothered to tell me the Alfa drivers insurance pursued the claim and won, In my opinion they should have won.

Surely the Alpha driver was going too fast or not paying attention.
Hmm you could have a problem here. A lot will be down to what the truckers that saw it report.
Their report could be anything between
scenario 1
wife not paying attention, dawdling in fast lane, frustrating traffic behind. When someone did undertake there was no collision, your wife was just suddenly 'woken up' by the manouver and hit her brakes causing a skid. The poilice would be looking to pin a dangerous driving on someone for that, and she may get some flak if thats the way the story goes.
scenario 2
complete nutter undertakes when there is no room to do so, hits your wife and knocks her off the road. Not much argument there.
It sounds like the driver stayed to get his side of the story to the police and hopefully lend assistance to your wife. Pretty much it will be down to what the independant witnesses say.
Wish your wife a speedy recovery, and I hope it all goes well.

Wife was defo not dawdling she was driving a fairly powerful car and was overtaking trucks a little quicker than she would have liked, BECAUSE she felt pressured from behind. There was no traffic up ahead so no excuse for the other driver to swerve back in front of her. It was a completely aggressive manoever on behalf of the other driver. seems that he either wanted to race her or was just trying to scare her....WHY?? Who knows!!!!
Thanks for all your kind comments.
