Morning all,

My mum got a NIP this morning, 86 in a 70, however the offence was on the 18th of March and she didn't receive an NIP within the 14 days although the letter which arrived today says they sent an NIP out within the 14 days. Anyway, I'm going to get onto pepipoo to try and sort that out. We believe she was caught by a speed camera van which was parked on the side of the A92 in Scotland, however I remember that one of the vans (there were 2, spaced about a mile apart the cheeky censored ) was parked up on one of the little mound things by the m'way which police cars sit on and are signed as "marked police vehicles only". Can scamera vans sit on these? Are they defined as a marked police vehicle, or is it just for traffic cars?

Thanks

Yes the vans can park on the platforms as they are a police vehicles. Also these vans have a moving video camera which can be used to prosecute drivers for other offences such as bus lane encroachment or no hands on steering wheel etc. (A92 cant ba a motorway- A92(m)?)

Except for when police officers like to distance themselves from such operations, and then they belong "solely" to pratnershits and are nothing to do with the police...go figure.

Get on the phone / write and ask why the NIP wasn't received within 14 days.
Is the address on the V5 correct? If it is, then the NIP *might* not have been correctly served, and you'll be able to suggest they go forth and multiply - greater minds than mine will be along shortly!

If you didn't receive the S172 first time then afaik if you say that under oath then you're ok, or something. I also think that in *Scotland* you can just return the 172 unsigned.

Hey tigger1,

I've been reading Pepipoo, and it seems that with some Scottish forces, the first NIP often doesn't arrive magically rolleyes Can't use PACE defence unfortunately, trying to decide between sending a non signed form back, or go for a PACE letter without the PACE bit. Does anyone know if you can request evidence first (photographs) then go for PACE/non signed NIP? Do you have to fill out the NIP to resuest further evidence?

Sorry, I've read a lot on Pepipoo but its all very technical jargon and some of it has confused me confused

Thanks

Imbecile/anyone else in the know - had a letter back tonight from Fife SCP with photos and saying that they sent the original within 14 days so have met their statuatory notification requirements, which I know is balls from the RTA. Anyway, can I ask why everyone suggests the S172 shouldn't be signed? What does this do - does it make the S172 invalid? Can they argue you havn't provided all the details requested? Or should my mum just sign it and then argue the 14 days rule?
