What are they looking at?
Discussion
It turns out a friend of the wife got busted by South Wales Police for drink driving. Just wondering what they are looking at, so over to the collective....
Circumstances are that they were involved in a single vehicle accident (airbags etc) which resulted in zero damage to anything other than their car. No injuries and the accident happened within 1/2 a mile of setting off. She tested positive at the roadside and at the station (dont know the level though). She has a good solicitor sorted out and is up at court on Friday.
What is she looking at? I thought a 1 or 2 year ban with a potential of a re-test and / or rehabilitation. Also I would have though a couple of hundred quid fine too, but not sure. What does anyone else think?
Just for reference, I completely disagree with the circumstances and the end result. But its done now and I guess my wife needs to be there for her friend

Maximum penalty in the uk is upto.....
6 months imprisonment, a fine of up to £5,000 and disqualification from driving for at least 12 months (3 years if convicted twice in 10 years).
Also
you'll have a criminal record
you won't be allowed to drive for at least a year
you could lose your job
your lifestyle could change dramatically
you will have higher insurance costs
your driving licence will be endorsed for 11 years
during that time you will find it difficult to hire a car or get a job if you are, or hope to become, a professional driver

Hope it helps.

12 month ban and a hefty fine is about normal, unless she was mega

Yeah, that is what I thought too. Lets see. She is going to plead guilty since its on CCTV and the police caught her red-handed so to speak. Done the crime, now time to take the punishment.
She is a pretty big earner so I suspect the fine will be means tested too. But lets see.

I had a friend who got done years ago but because he was a poor student he got a 2 year ban and 120 hours commy service but no fine. Court told him that CS was implied due to lack of fine so you may find she'll get a ban and hefty fine. Ok, she got 18 months ban and a £900 fine. No points and no community service. So I guess that it was a fair judgement based on the fact that she has lost her driving license for a pretty long period of time. A little more than I expected but she will have a major trouble getting insurance come the time she gets it back. I hate to think how much it will cost - suspect its a good idea to start saving now!
Still, funny thing was that the Police were pushing to show the CCTV that they had. The magistrate didnt really want to know since it was an open and shut case. The Police got a bit shirty about it, but the magistrate would have none of it! Not sure what that was all about. Still, over now.

Peter Ward, are you listening!?
Isnt it funny when video evidence supports their case they will try to insert it into a case which is already won...
Yet, when it might no support their case, there are all types of reasons like the Data Protection Act and others why it could not possibly be done...
