Not me, I hasten to add! I realise that this is one for Pepipoo, but I figured you guys would be able to give a quick response to this question...
The good lady's little brother has been done, within an hour of insuring his first car, 51 in a 30 by a scamera van.
At the base of the NIP is a note that reads :
"The fixed penalty procedure is not applicable to this alledged offence, you should not send your driving licence or any payment with your response"
Is this a bad omen? Does this mean that he isn't going to fall into the 3 points and be good category? Obviously he has just passed his test, meaning that if he gets 6 points it's bye bye driving!
Thanks in advance for any responses..

The upper limit for a fixed penalty in a 30 limit is 50, which is why this one is going to court.
Probably worth 4 or 5 points and up to £100 to £150 fine plus costs.
It's unlikely to be 6 points unless it's more than just speeding.

Is it not because the NIP is purely to identify the driver? Would he not get the conditional offer of a fixed penalty once he's returned the NIP...
John.
John.
The NIP is to inform you that an offence is alleged & prosecution being considered.
Sec 172 ntoice is the requirement to name the driver.
Conditional offer (if applicable) or summons follows once driver is identified.

...however, giving his driving record (read NONE), the mag. my decide that he needs to have a refresher test and give him 6 to ensure his licence is revoked

Thanks VH, since posting I've had a chat with ma (mag) who has confirmed that and potential "sentencing"..

Muppet! If his driving has declined to the state where he exceeds the speed limit by such a considerable margin so soon after getting mobile then I hate to think what he will be like in 6 months.
This is what the probationary period is designed for....
