Time limit for speeding fines
Discussion
I was caught on Camera in November2006 near Aberdeen.
I recieved a letter with in the 14 days but it was not recorded.
I sent over 100 wedding invitaions last year and 10% were lost in the post so i denied recieving the letter from the police.
Work the system!!!!
I then received another recorded letter outwith the 14 days which my postman signed for and stuck it through my letter box. Cheers MR postman!
I sent them letter explaining that i was not sure who was driving that night and asked them for photographic proof.
I received pics through the post but they were not very clear.
I took them to a lawyer who told me to tell them to F off and ignore the case.
(Can i add that it was free advice thanks Adare & Bryden)
I have never heard another thing about it.
Now that i have said that, i am sure a letter will arrive on Monday morning.
My theory is if it arrives recorded delivery then they probably have a strong case, if it arrives by normal post then it is shakey and they are hoping you will just pay it.
Question is how long do i have before this case will be dropped for sure and i am in the clear?

If this was in England then the authorities can 28 days after no reply to their request to name/shame the driver lay an information before a JP outlining the offence of failing to name driver. They have 6 months to do lay it after which they cannot proceed if they have not done so. After laying the information then a summons can be issued/served at any time even outside 6 months.
Again they will have to prove that they sent the request by post which normally accompanies the 14 day NOIP. Unlike a NOIP no specific method of posting is mentioned.
Interpretation Act applies as to how served and if correctly addressed and posted deemed to have been served unless the contrary proved.
I think this is the same for Scotland as 1988 RT Act applies up there.
Another couple of months and nothing heard I would be thinking it has been binned
but the wheels of justice do grind very slowly at times.
