A strange question

But at which point does a car stop being a car in the eyes of the law with regards insurance and tax etc.

I ask as i am occasionally helping folk out by dragging their dead cars around. Like last week i was dropping off a dead car to the scrapyard which had a body made entirely of rust and no engine or gearbox or wheels for that matter. If i had for some reason to turf this off my trailer and leave it at the side of the road for a few hours with every intention of picking it up later would i of been open to be charged with keeping a car without tax or insurance etc.

I know that most folk would say use common sense but that is a very dead concept

There is a plethora of case law on this and it would seem if it is such condition that it has reached the end of its usefullness and there is no intention by the owner to repair and put back on the road then it no longer is a motor vehicle. Missing parts such as engine does not effect.

Sorry no hard or fast rule each case has its own considerations and decvision by Mags.

On what you state don't forget offence to dump carcas/litter at the side of the road.

Okay no intention to return it to the road

So how about a 4x4 that has been hugely modified so it is never going to be road legal again but still has wheels and an engine.

The reason i ask is i am off to pick up a landy from glasgow while at the same time the GF will be driving the caterham back just if the 7 goes ill it is going on the trailer and the landy gets left somewhere

in terms of the law, it is a car if it is a mechanically propelled vehicle made or adapted for use on the road. However according to case law it remains a car as long as you can ccontrol steering and propulsion
