A friend (no really!) is selling his SORN'ed Land Rover this week end.
It has a flat tyre that leaks.
And a spare that's very close to the legal limit but sound.
The potential buyer will bring a towing bar.
Would it be illegal to tow on the balding spare? I think it'd be safer but the alternatives are to ask them to keep pumping up the current tyre or to find a trailer which will clearly cost money...
Any advice gladly recieved for onward transmission

Technically the towed landrover is still a motor vehicle and as such will require its own Excise Licence. No provision under SORN to use it on a road unless licensed.
Will also require MOT and Insurance.
Regarding the flat tyre offence under Con and Use to use a tyre not soi inflated as to make it fit for the use to which the motor vehicle is being used. This would be in addition to lack of depth [if disclosed]on the other one.
Look a bit like a probationers delight.....
Peace of mind get it fixed or trailered.

Close to the limit but sound = completely legal
Put the spare on, no problem
Milstead v Sexton [1964]- a motor verhicle which is being towed by another motor vehicle remains a motor vehicle and for the time being becomes trailer also.
Cobb v Wharton [1971] - nothing in Vera exempting a mpv which is being towed and is for the time being a trailer. Also held mpv does not cease to be 'used' for purposes of Insurance when towed by another vehicle so 3rd Part Insurance required.
This backed up in Nic hol v Leach [1972].
As as I am aware the drawbar does not alter the state of it being a towed vehicle.

As I understand it if all the wheels are on the ground, irrelevent of bar/rope/frame then it is classified as a motor vehicle requiring mot/ins/tax, if however the vehicle is partially lifted ie on an spec lift dolly then it becomes a trailer.
So if i need to pick up a car, then i could request that the AA do it with their dolly that raises the front wheels?
