Requested the evidence got a single picture back with the number plate unreadable...
They must have at least one image where your plate is legible, otherwise how did the NIP find its way to you ?v9gue said:
..and driver and passenger both unrecognisable because of the very poor quality of the picture.
They will say, quite correctly, that the purpose of the photograph is not to identify the driver. They rely on s.172 of the Road Traffic Act 1988 and its threat of criminal sanction to encourage you into either 'fessing up or nominating another..v9gue said:
Can this be used as evidence?
As proof of driver identity ? No.As proof of an offence of excess speed ? Yes (although they will almost certainly produce a zoomed / better quality image if matters were to progress to court).

Thanks for sharing your experience regarding the court.
In the picture provided as evidence, the numberplate is not just hard to read, but completely unreadable.
yes it was me, well i was travelling the same road at a similar time. I'm just shocked at the shoddy evidence had i been a more dubious character then i think i could in all fairness say that the documentation provided did not either idenify the car or the driver.
I don't think i was over the limit at the time of which i also stated in a letter asking for the case to be reviewed and for the eveidence to be provided, a second photo a few seconds later showing me doing the same speed and i would be satisfied the case was proved to a point it would not be worth argueing over.
Is it not reasonable for a case to be proved these days?
I might add that it was on a 3 lane carrageway in the last 100m strech of road before the speedlimit rises from 50 to 70, which is a little sneaky to say the least.

They must provide you with evidence before you enter a plea
Firstly, the OP has not been summoned for any alleged offence. And secondly, they are under no obligation whatsoever to disclose any evidence on which the Crown proposes to rely until a summons has been served and a plea of not guilty has been entered.

Just a thought - and I have no knowledge as to whether this is true or not - but I would have thought it is unreadable in the photo they sent you as it is printed in low quality. When they look at the digital photo - it is probably 100% readable. In the picture provided as evidence, the numberplate is not just hard to read, but completely unreadable.

Fight it all the way, always , even if you are guilty.
Dont let the bastards take you for an easy ride. Make them work for their money, because thats all it is, especially on the road you described. Its nothing more than a tax. Dont you pay enough all ready?????

It must be proved by the prosecution beyond a reasonable doubt - this is true for murder, rape, robbery, assault etc..
Sadly, for speeding, this is not the case.
Yes it is, stop whining.Sadly, for speeding, this is not the case.
