Hi chaps, posting on behalf of my boss..

situation: caught at 121mph on the A55 in wales, sunny day, good conditions all round...likely penalty?

I have searched the archives and come up with nothing!

this could have serious implications for his job, family etc, so help is appreciated - where to start looking for help: pepipoo? freeman? who's got any links? thanks!

..i've no doubt he'll be along in a minute to explain it himself once he's registered and can post!

biggrin

He's going to get the book thrown.

As for "serious implications" he should have thought of that before he got his toe in so hard, but there but for the grace of god and all that.

How was he cuaght?

Over 100mph is a ban pretty much anywhere in the UK. His need for a car might influence the period.

But "They don't like it up 'em, Captain Mannering" in Wales at the moment. I presume they prefer it up the sheep...

This in the short term is exactly what I would be asking. With a dodgyscope it opens many avenues, although as mentioned Pepipoo is the place to be.

caught by laser hand held gun on the hard shoulder facing his direction of travel...only spotted it when gone past it in his rear view!

Huge. Big, bad and he'll really pay.

General guides at the moment (info via solicitor pal specialising in these things) are 'book thrown at you'for 100 - 110, but above 110 all bets are off. They go nuts...

Custodial sentence is a real possiblity.

Surely only if was deemed dangerous.

I got nicked by a hand held speeding device in a traffic car parked on an exit ramp hard shoulder on a bend. Reasonably confident I wasn't doing more than a ton, but the reading was 121mph @ 85 yards? Are these things often inaccurate? No paperwork given to me nothing to sign, is that usual? See my post.

Nah - the prisons are full.

I'd be deeply upset if mere speeding [ no deaths,
no injuries ] got a session in one of
the Windsor hotels [ all the daytime TV you
can eat, three meals a day and a nice social
worker to chat to].

He's much more likely to get a month or so ban
and a large fine.

There have been a few cases where dangerous driving charges have been brought because the speed was very high, but we seem to have got away from that during the past year or two. As I understand it you are now unlikely to be charged with dangerous driving simply on the basis of the speed alone - so at least that's a slight improvement.

Can a dangerous driving conviction lead to a custodial sentence, even if there is no shunt?

Best wishes all,
Dave.

Absolutely not.
There is no facility within the law to hand out a custodial sentence for speeding alone.
Dangerous driving would have to be proved.
Note I said proved, not assumed.
