The son of a friend has recently been arrested and charged with assaulting a policeman. I have little doubt he is guilty, he also has some previous history of driving offences and what I would describe as "chav" type criminality i.e. drunk and disorderly etc. What could be the likely outcomes assuming he is found guilty? I have advised friend it is very serious she seems to be playing it down and considers it a minor inconvenience.

I would appreciate any input.

Cheers pp

If theres any justice he'd be put in the stocks for a week. Right next to the police station car park entrance and a big puddle.

Police Act 1996 Section 89

Summary trial: 6 months impr. Fine of £5000 or both.

Not dealt with nowadays as it should be. Imp and keys thrown away.

The sad thing is, the boy probably has nothing to worry about

Depending on how serious the assault was, in scotland he's be lucky to get a fine

Small fine if that probably. Depends on assault and level of injury. Highly unlikely to get a custodial.

Small fine/bound over/conditional discharge. Take your pick.

When a person I know got charged with assault on a public sector worker I was told the maximum sentence is 5 years imprisonment, although it was ABH if that's different.

Have seen fines as low as £20 for assault on police, personally I think 1/2 hour in cell alone with a big copper.

He SHOULD be given a proper sentence. Violent crime is violent crime, and isn't acceptable without SEVERE provokation (e.g. someone properly hitting your missus or kid).

Moreover, the police should be seen as inviolable, and violent crime against them doubly punishable...not because they're any the less able to protect themselves (quite the contrary), but because they need to be able to go about their jobs without fear.

But agreed...the daft mags will probably tag him so he can burn it off, put it on the cat, then go to the pub and start another fight! rolleyes

Given the state of the 'criminal justice' system nowadays he'll probably get a PS3 with half a dozen games and 50 quid a week.
