Hi I got a PCN a few weeks ago, "nothing new there you say" yep!! so I made a representation.
Yesterday I thought I would call them up and ask when I could expect a response, because I was going on holiday for 4 weeks.

The response was ....

PCN Dude on the phone....

" you don't seem to have your priorities right, how can you take a holiday when you are waiting for the response...."

Me...

Excuse me, are you saying I can't take a holiday because I have a representation waiting?

PCN Dude...
" you have chosen your holiday over the PCN...

Me.. So should I send a letter notifiying that there will be nobody to responsd if the representation arrives..?

PCN Dude... No, if you do not reply whilst on holiday you will have to pay for the full PCN!!

....................... No that is not fair is it??? ....................................

I think you need to review your priorities matey boy. smile

On a similar subject, what happens if you get a NIP while you're away for 4 weeks? Is there a limit to the time that you can respond before they send out the heavies?

If on receipt of PCN you made a representation to the LA of your innocence then they should have either

(1) Accepted and informed you so, or
(2) Sent you a Notice of Rejection of Representation, giving the grounds why. This also will give information of your right to appeal to Parking Adjudicator within 28 days of reject Notice.

From what you posted they haven't done this?

Or are you getting the 'bums rush' from the PA which I find hard to believe.

Two courses then

(1) Let sleeping dogs lie, but one never knows what the other is up to?, or

(2) best remind them of their obligation to acknowlege your representation either for or against so that if you wish you can go further to the PA if you have strong grounds.

Could it be theirs was 'lost'in the post in which case they may well increase the unpaid penalty by 50%?
