Just had a call from my son who has received a letter from the BiB saying something along the lines of
"I have been advised that the driver of vehicle reg number XXXXXX is alleged to have commited the following offence 'exceeding the 70mph speed limit'"
and they now require him to send in his documents and licence.

Is this an example of the 'Judge Dredd' police methodology we are to expect? no proof, no second witness just an allegation followed by a fine and points?

What's going on with the topic title? Is that the incident number? If it is, is it a good idea to post it?

I'd be interested to know what it did say to help gauge what might have happened, rather than have to guess what 'along the lines of' actually means in this context.smile

Could it have been an off duty officer who saw the car being driven at 'over 70mph'? A friend of mine was prosecuted for the same offence after a panda car spotted his bike on the M6 doing considerably more than 70mph. No exact speed could be given, but by the time the panda driver realised the bike was coming past and he could react blues and twos fashion, the bike was pretty much gone.

Check back with son.

Does the paper work contain information that the driver of motor vehicle so and so of which he is the Reg Owner is to be reported for the consideration of the question of prosecution for exceeding a speed limit at....on.....at? (NOIP)

Further is there more paper work that requires son as Reg Keeper
to name the driver at the time of the offence? (S 172 RTA 88)

If so your son has been flashed and SCP are on the case for their £60 and 3 points on his Licence.

There is power under RTA 88 for constable to require production of Driving Licence/ Insurance and Test Cert but only:
the person driving on a road,
or has reasonable belief to have committed offence in relation to use of vehicle on road,
or involved in accident. (S 164/165 RTA 88.)

This is generally made after a stop or follow up. As from what said at start of post there does not seem any connection to the power to demand docs to be sent. There are mysterious procedures creeping into Plod procedures these days but I have never heard of this one.

Check back, as I say, of son.

It says

"I have been advised that the driver of vehicle reg number XXXXXX is alleged to have commited the following offence XXXXXXXXX and I require you to provide the details of the driver within 28 days of this notice"

No photo just an allegation, it's like an NOIP but without the proof

Its a NIP - and all that is required is an allegation, no proof needed at this stage.
