I have done some digging around on here and have found some conflicting comments, so I'll ask the combined masses the question instead:

Due to my own stupidity (well, forgetfulness) I forget to get my MoT and Tax renewed before the deadline. This wasn't a (legal) problem as such as my old Sierra hasn't moved off the drive for 3 months. Anyway, I booked the MoT for today, which it failed (it needs a brake pipe joint replacing and also some welding doing - as 1991 Sierras tend to). Looking at one of the postings, it appears that I shouldn't have actually driven it home after a failure. frown

Anyway, tomorrow I will book it in for welding at the garage which is approx 1.5 miles away (nearest one that does welding).

Q1. Can I drive it there? I saw a reply on here that said it may be driven to a place in connection with repairs pertaining to the MoT.

Q2. How long before the Dept of Transport get snotty about the expired tax? One comment I have had is that it should be SORN'ed, but it would need to be un-SORN'ed to drive to be re-MoT'ed after the work. As intend getting the work done ASAP, I'm not sure this is viable.

Cheers, much obliged for any clarification!

You can drive a SORNed car to an MOT station without tax. You just need an official appointment.

If you want to be 100% safe of PC Petty, then get the garage you are driving to for repairs to book you in for a shadow MOT.

If you do get stopped, say the car is going in for the MOT. If the copper wants to, he can phone and get confirmation you are booked in.

He can then do nothing. Nothing.

( Well, he could state the law says you shoule be going to the closest MOT station, but if you have met this type of copper you are going down no matter what )

Having recently met the above type of copper, I would play safe and get the garage to book you in for an MOT...then they just do the repairs instead, the MOT afterwards. Twisting things a little, but still within the law and PC Petty safe.

Fixed penalty notice for not declaring SORN comes in the middle of the second full month after the tax expired.

Declare SORN online as soon as you can, if the car can't be taxed immediately - and backdate the tax to when the last disc expired if you don't declare SORN in the interim.

isn't having to declare SORN not the same as having to prove you are Innocent, something that goes against the grain of English Law?

it's just the same as having to prove you are who you say you are, again Contrary to established Law

how was SORN ever allowed to be?

Certainly for driving without tax you can only drive to/from a place of repair AFTER failing an MOT, I think SORN is the same, hence the above advice is good.

Cheers folks. I'll ask the advice of the welding garage, it will certainly all be pre-arranged and "official". Much appreciated smile
