I recieved a N.I.P yesterday informing me that i had been caught doing 36mph in a 30mph limit on Sunday at a spot where i know there is NOT a camera, so i presume police were hiding in a bush wink

Am i able to request a photo/print out for proof?

would i be wasting my time/causing more problems for myself if i appealed explaining the i was in a TVR and knowing how dodgy the dials are in them (false readings) the speedo was saying 30mph not 36mph.

Or should i just accept the £60 fine and 3 points (have had license 19 years and kept clean)

Glyn.

From what I understand, you can ( and should ) ask for a photo to help you identify the driver - although, alarmingly, the police do not HAVE to send you any evidence they may or may not have until a week before it goes to court.

So asking for evidence risks being ignored, asking for a photo ( your hope being it then confirms the speed and exact location ) is not easy for the police to ignore, as if it came to court for you not identifying the driver, you can easily point out how unhelpful they were.

The problem is that if you do not return the NIP within 28 days - and that waiting for the photo does not extend this - they will simply drop the speeding charge and do you for failing to identify...and as you DID fail to identify ( by not responding with a name or names in 28 days ) you will go down and the fine is usually much higher than £60.

It seems the whole system is based on stressing you to incriminate yourself and take the easy option, especially for the police, that you just pay up.

The only time your point about the TVR and its speedo will ever be heard, will be in court, if it goes that far. I would not expect magistrates to be sympathetic to that, in fact I'd worry they would fine you more for being in 'such a dangerous and unroadworthy vehicle'.

Complete tosh of course, but I would not say I had a dodgy speedo in court!! Not when the police are trying to stuff you, too!

Mentioning it on the NIP will make no difference whatsoever - the offer of a £60 fine and 3 points will be the next you hear.

The above is only what I have been reading to - I am awaiting a NIP for...wait for it....a dastardly 34 in a 30.

Like you, I was in a fancy sportscar that day.

I'm sure it is pure co-incedence........whistle

PS: So don't ask for EVIDENCE...ask for a photo to help you.
