Speeding help?
Discussion
Hi Guys, Just after a little more info please. My dad got caught speeding a couple of days ago by an unmarked car. After being pulled over and being told off by the officer he was told what speed he was doing and given a ticket. However he wasn't shown proof of the speeding, i.e, he wasb't sat in the car and all the talking was done on the side of the road next to my dad's bike. Can he contest this ticket as he doesn't think he was speeding?? Any help is much appreciated, cheers Mike
How was he clocked?

In the case of the later two a good Plod would show the reading but he is now obliged to do so. [Westwater v Milton (1980)]
Obviously where the calibrated speedo of the patrol car is being relied upon the needle will have dropped back to zero.
He will have been given a Fixed Penalty Notice (pay £60/3 points on Licence). In the next 28 days from issue he has to decided to either pay or elect Court hearing. A not Guilty will place an obligation on the prosecution to disclose all their evidence before the case under disclosure rules.
But, if found Guilty, he will have to pay a higher fine, the cost of prosecution (anywhere between £3o - 60 or maybe more) and a £15 Victim supplement that is now being levied in such Court cases.
If he does not respond one way or the other to the FPN in the time limit then the sum payable goes up and it is registered as a fine with all that entails.

Is that young Mark in trouble at an early age? It looks as if the fellow has 'previous' or 'form' - or whatever the current term is. Follow,

Best wishes all,

Just spoke to him again and found out the unmarked car was a couple of cars back sso would they be able to clock him? Once he realised it was a police car he slowed down and wasn't speeding when they were directly behind him.
Doesn't matter if there are vehicles between for Vascar or reading from speedo. So he was speeding before they got directly behind him then.
