How far would be taking the P@SS?
Discussion
We all know you can drive to & from an MOT without tax as long as it is pre-arranged etc. For an MOT test, there are plenty of garages in any given town, so its normaly a short trip.
My car needs a VIC ( Vehical Identity Check ). The nearest place is about 60 miles from me. When I spoke to the bloke on the phone at VOSA he said it was no problem as it would be pre-arranged etc, and I could drive it there ( as long as it was MOT's & insured ) as I could not buy a tax disc without the test.
My office, is also about 60 miles away, and about ten miles from the VOSA test centre that will carry out the VIC. If I was to drive to work in the morning ( parking off road on private ground while at work ) and then drive to the VIC test at lunch time, would that be seen as taking the P@SS by BiB or if I passed an ANPR check on the way to work?
The car would be MOT'd and insured, and I would buy the tax ASAP after the test ( iether at the post office close to work if I drove directly back there, or if the test took most of the afternoon, I would drive directly back home and get the tax the next day ).
Anyone got any experience of this?

I do not actualy know the time of the appointment yet.
Hopefuly it will be in the morning, and I will go straight there, and then to work after. ( and buy the tax when at work, which would mean it was on the car quicker than if I drove home, although technicaly I suppose I should go directly home. )

LORD JUSTICE HENRY: I agree and would add only this: I am surprised at a time of financial stringency that public money was spent in the pursuit of this appeal. It will be dismissed. Paragraph 15 implies to me that you can stop on the way ( to get fuel etc ).
The reason for my post, is that while my work is in the same direction, it is not "on the way".
At the end of the day, the appeal was dismissed, so that presumably means that if I was seen then I would also loose the case.
It looks like the safest thing would be to take the day off work and go directly there ( unless I can get an appointment for the test first thing, then buy a tax disc from a post office near by before taking the car from the test station ).
Or, I could send of the V5 saying I have sold the car ( to a made up name and address ), buy myself a hooded jacket, and drive round for the rest of time with no worries. That may be easier....

So all your missing is an MOT and you are worried about driving 60 miles to a VIC?
Plenty of kit car builders drive 100 miles+ to an SVA test without number plates, tax, MOT, ministers approval etc! I know a few police officers who have. The only issue I had when I drove 60 miles each way to an SVA test was a prat in a 406 flagging me down to tell me I had no number plates.
You are allowed to drive to/from any test that is required to get your car properly registered, taxed and MOTed so long as it is insured. Once you fail a required test you are also allowed to drive it to a pre booked appointment to have the failures rectified. So interestinly if you know your car would fail an MOT you can't drive to a garage to get it repaired. Instead you have to go and fail an MOT and then go to get it repaired. If your car is deemed too dangerous the tester can issue a prohibition notice, in which case you can't drive it to/from any tests or garages until the prohibition is lifted.

Using a vehicle without Excise is not a criminal offence it is a REVENUE offence.
Plod alone cannot prosecute this - they have to get the authority of DVLA if they wish to take action.
On the journey you mention if stopped then if they were to take any action despite your explanation and evidence then they would submit a form to DVLA notifying then of use without. It used to be on that form there was space for reply by offender as to why.
In the meantime and before Plod got back to the Office and submitted the Form into the system you have visited the local PO and obtained said Excise Licence covering use to the beginning of this month.
Lo and behold when Plod's form (CLE 2/6)arrived at DVLA they check their records. Surprise.....the vehicle is Licensed...NFA
Which only leaves the criminal offence of failing to display a current licence - Home Offence Offence Group 810 for purposes of FPN - fail to display a current Licence. My sheet states "Verbal Warning only" I have yet to hear anyone taken to Court simply for this offence.
IMHO there are bigger fish to be court(?)than BigDunc on this run.

Interesting - might explain why I was never pulled for having a tax disc 7 months out of date on the screen
I'd bought the new one 2 weeks before it was due and completely forgotten to put it in the screen!!!
