My nephew has received an S172 for 99 in a 70 on the A66 (Cumbria).

I've tried to find the trigger speeds without luck. Is he looking at a court appearance or FPN?

Cheers

He may only just be lucky here. We do know of one local 99 mph on that stretch who got a Fixed Penalty. That road's notorious for Steve's vans. rolleyes He particularly likes the 60 mph stretch as a lot confuse this as a dual carriageway (single carriageway as the lanes separated by paint hatchings and not a tangible verge or barrier rolleyes)

Thanks, Von and MM. I figured as much.

Am I right in thinking that a S172 is used when the alleged speed is over the FPN speed? i.e.

70 to 79 - no action
79 to 85# - FPN
85# + - S172 then court

  1. or whatever the court trigger speed is

I think its actually 70-77 no action, 77-95 FPN and 95+ it goes to court.
I got done for 99 in a 70 when i was a student and i got 6 points and £200 fine. It does depend on the road conditions at the time. Good luck! cheers Ed

They can prosecute for anything in excess of the posted limit, if they deem it appropriate to do so..

Typically (in a 70), though:

upto and including 78, no action
79-95 - Fixed Penalty
96+ summons.

As Mad Doc say above - we have villager who got FPN for this on the A66 (70 mph bit. In 60 mph - definitely "Mornin' judge)&quotwink

But I think general rule of thumb - they cut off at 97 mph per a local BiB here as far as court v FPN concerned.

I think your nephew need to get decent legal advice as to how to present himself in the court to try to mitigate outcome to best outcome for him wink I not know what the norm ist - as I not actually drive at such speed on A66 etc und I always on alert for these darned vans anyway wink. I always know where they will be.. on the nice tasty lick straight rolleyes anyways rolleyes I can only say middle aged villager was done for 99 mph und fined 60 crisp "oncers" with three point on licence. But he did this speed at dawn when taking child to the hospital. Child has diabetes. He only needed glucose tablet to correct the "blip" - but the Papa (estranged from wife und not used to this as he had his son whilst she having operation herself) hit panic button, which only natural reaction really. I think this also taken into account perhaps as he did write to Steve to explain in hope it got cancelled. rolleyes We told him he should have contacted the "Gazette" - but he felt he had pushed the envelope a touch too far anyway rolleyes

But if court - get legal advice asap to explore any mitigating factors & behaviour/presentation of self in the court.
