What's the chance of a ban?
Discussion
Quick summary; 6 points on my licence (all scamera - never been stopped by a BiB saying I was driving like a turd so I'm pretty miffed - but it IS the law) and got flashed again. Went the PACE route, got the summons through. Been on Pepipoo and watched cases and soon realised that I don't have the brain or stamina for the fight so decided to plead guilty by post.
Was informed by the court today that there is a chance that as the are entitled to give between 3 - 6 points I could end up with a totting up ban.
Court was being informative, not alarmist, so what do you think the liklihood of a ban is? Slight complication that they did me for no insurance as I'd forgotten to inform the insurance company of a registration plate change, but I received a confimation letter from the insurers to the effect that I was actually insured at the time, so this should not impact the situation from what I've seen so far.
All contributions gratefully received....

Surely it should be a FPN if you only have 6 points and have been driving over 2 years?
Yeah but they might load it up because I went the PACE route and refused the initial three offers of a FPN.Don't get me wrong, I'm not wealthy but the points mean more to me than the fine. So if 3 and £200 it will be a salutary lesson that one shouldn't mess with them, unless prepared to go the whole hog. But preferable to 6 points, loss of licence, and probable refusal from my insurance company to cover me on the TVR!

Min 3 points, most likely 4. You should argue that you need your licence for work ect should they really hammer you and give you 6....expect £200 to £300 fine and about £50 court costs.
So possible that they could be antsy and go for 6? Guess I'll just have to wait and see. Sigh...T40ORA said:

To get 4 they would have to for some reason why they should need to come away from the guidelines set.
Sleep easy!

Where would one find these magistrates guidelines, out of interst?
http://www.pepipoo.com/Magistrates_guidelines.htmTo the OP: I'd say chances of getting 6 are slim to none. You were pretty lucky on the insurance front, huh.

Apparently it does happen quite a lot, and as there is nothing to be gained (plate transfers can be tracked back to the original registration) the insurance company responded with no qualms.Edited by mrmr96 to correct link

Although, as you say, lucky as they might have been difficult.
And feeling easier about the 6 points situation. Thanks.

The clerk was probably covering their arse just in case the mags decide to go senile and ignore them. Alternatively they had their self-righteous cap on, and as a speeder no doubt as evil as a child-pornagrapher and thus deserved sleepless nights over the potential loss of your career over going over an arbitary 'limit'.
Which is most likely?
Seriously though, even if they did *all* have a senile moment and give you 6 points you could appeal immediately and the six points are put on hold pending your appeal. Your appeal would no doubt win and it would be reduced to 3. Thats very very worst case, but either way, you should be fine.
