a bit of advice please ...

about a month abo, Mrs.V had an accident with a Limo that had wandered into her lane and struck her mirror hard enough to completely oblitorate it. The Limo failed to stop.

Mrs.V took the reg plate and reported it to the police who advised the owner / driver had 24 hours to report the incident.
Anyway, 3 weeks down the line, we have recieved a letter that basically says "we cannot find any damage to our vehicle ... F**k off !"

anybody have any advice on where to go next ? seems to me were in a catch-22

3 weeks later they wouldn't have - it would have been repaired by then...

Back to the police? Ask them for assistance?

Surely the best way will be to go through your insurance company? Get some legal help from them. May take a long time though if the limo company denying it.

no point in using the insurance company .. the excess on the policy is £250 and the damage cost me £250 to repair ... will have a chat to the police first...

Cheers for the advice

The fact that they "cannot find any damage to their vehicle" does not necessarily mean they did not hit your wife's car - damaging its mirror. It may have a very teeny dent which they had fixed by a paintless dent remover chap. They may even have their own "ding that dent" kit. You can buy the kit & the training to do this on line. I have such a kit because of the muppet mumpty brigade who can bash a car with shopping bags etc. :;rolleyes: If you really look hard - you can see the trace of the repair though .. wink

Also - it might have been a scratch which would T-cut out with a bit of "elbow grease" rolleyes

In the former - might be a "paper trail" if they used firm like "Dent Devils" - which police might be "bovvered" to check on if you are lucky wink.

In the latter of the T-cut or DIY repair - difficult to prove. rolleyes

If there was any CCTV cam - perhaps you should try to get some footage of this incident if you can.

It not perhaps what you like to hear that this idiot "get aways with it",.. but they do say "what go around - it come around" in all lingos wink.

Someone wants reminding of the wording of S 170 RTA 88.

If

owing to the presence of a mechanically propelled vehicle,

on a road (or public place)

an accident occurs,

which causes damage,

to a vehicle other than that vehicle (or trailer drawn)

Driver shall STOP

give his name and address, that of the owner and vehicle details to any person having grounds for requiring them.

If details not given then report to the Police as soon as practicable and in any case with 24 hours.

If injury involved then Insurance details to be given or produced.

Damage has been caused to Mrs V's vehicle so obligation on the other vehicle to STOP and exchange details even if none to the other vehicle. So two offences if not done. No requirement on mrs V as no damage(?) to otjher vehicle.

The problem is that in relatively minor collision the High Court have said that one has to prove that the other knew damage had been caused for the offences to be committed. No damage to the other vehicle would tend to support a 'get out'?

Looks like an Insurance jobbie or if details of other parties Insurance known make a claim on them for repairs.

yeh i see your problem. what about a threatening letter from your "solicitor" (just write it yourself)? it may get them to cough up?

They write back to "solicitor". If you pretend to be one.. it actually a prosecutable offence rolleyes

Besides .. you are talking to a firm which hire out these Limos. They still probably take no notice. rolleyes I think perhaps the OP best to go back to police.. und also to see if any CCTV record this incident for him. Also maybe he could send photo of the damage to show its consistency with collision as he report it. He should also tell insurers as they may well write stroppy letter to recoup the cost of repair. It does not matter if OP not liable.. they still sharks looking for chance to load policy anyway. rolleyes But it a matter of principle. It not an easy one to get justice over given the claim of no damage nor even recall of a clonk around the car (allegedly on his part rolleyes)

Cheers DVD.

and everyone.

CCTV is a problem, we live in deepest darkest Hampshire / Wiltshire. UNless the local parish has started erecting cctv in the trees or hedge rows, there is no chance.
Looks like its gonna be knock for knock, and leave the failure to report up to the police.

Tempted to get the brake fluid out .. but im not that sort of person
