A question for plod, please....

I was moved along by an impolite* Scottish police officer yesterday near Donington, on the road past East Midlands airport.

....*Pining for Glasgow, probably...

There's a roundabout that exits into the business park at EM airport, or contines on to Donington circuit. I pulled off the roundabout and stopped on an access strip to a gated field. Being off the road, I thought I was not subject to the clearway rules and safe to pause for five minutes.

Old Scotty Bill thought otherwise.

Is it illegal to do this on a clearway, or is that road a special security case due to its proximity to the airport, with a clear missile shot at landing aircraft available to those so inclined?

No, it leads into agricultural land opposite the airport. Nothing to do with the airport.

Edit...

I know I'm easily confused, but even I know the folly of blocking a crash gate

There's a car pulled up next to that gate pretty much every time I drive past it, so you must have been unlucky.

No idea of the legality of it though I'm afraid.

Twill all depend on what is stated in the Traffic Regulation Order for that Clearway as to whether it also includes the verges.

My day we booked them on the A.1. being a named road under The Various Roads (Prohibition of Waiting) (Clearways) Order, 1963 but that only made it offence to stop on the main carriageway. It excluded verges as they were not part of the carriageway. Cannot at the moment find the modern equivilant.

As stated will all depend in what is worded in that particular Clearway order.

Thanks, DVD...

So how the hell are we supposed to know...?

And how do I find out about that particular road?

If Scottyplod is wrong, I'd love to get a ticket from the rude git...hehe

Bit more:

Browsing to come up with a specimen Clearway Order led me to a proposal for one by Harlow District Council in 2005 the wording being:

Prohibition of waiting on main carriageway
3. Save as provided in Articles 4 of the Order no person shall, except upon the direction of a Police Officer or Parking Attendant in uniform cause or permit any vehicles to wait ‘at any time’ in any length of road specified in the Schedule to this Order.

Exceptions - Emergency Service Vehicles etc

Restriction of waiting on verges, etc.
5. No person shall cause or permit any vehicle to wait on any verge (grassed or otherwise) adjacent to any main carriageway comprised in the length of, or situated on either of the sides of the road specified in the Schedule to the Order.

main carriageway means any carriageway of a road used primarily by through traffic, including any carriageway of slip road, but excluding any lay-by;

verge means any part of a road (including a footway / cycleway) which is not a carriageway.

So PC McMoovan may well have been right.

The Local Authority for the area concerned will have a copy of the Order.

Should be signed at intervals with the redX 'no stopping sign'

Hang on a minute...

Is a tarmac strip across the grass verge, leading to a field gate, strictly speaking...a verge?

I had a bit of a barney in a similar vein once.

IIRC the 'verge' extends 30'(?) from the edge of the road. But if the driveway is private ie you are behind someone elses property line (eg a recessed gateway with a hedge marking the property's edge) surely you are clear of the verge?

In my case I was waiting behind the property line of a garage and was accosted by a 'proper' traffic warden who objected on the grounds that there were double yellows on the road.

After a short discussion I decided that burying the blighter under my patio was far too much trouble and moved on........gamma rays on full.
