So ... will we see Police pulling thousands of people up for this? Or will it be like the phone ban almost ineffectual?

Just this week i've seen two people actually rolling up a fag while going down the motorway, i wouldn't normally care but one of them was in the middle lane going slightly slower than the lorries, the other was in the outside lane swerving around as though he was drunk!
I'm not sure if i want them to stop people smoking in cars or just clamp down on people sitting in the middle or outside lane making no progress.

So, is it an actual offence to smoke? I don't think it is.
If not then nothings really changed. Sure I'd agree that if you dropped a lit fag or some baccy in your lap and caused an accident you should be prosecuted.
Thats the way it should be I think. If it's felt that smoking has been a contributary to a driver causing an accident then the driver should be accountable for causing that accident. So drinking/smoking/playing with satnav/punching children in the back seat to shut them up/eating an apple etc etc. All have nothing to do with driving the car, and if they cause the driving to fall below standards expected then the driver should be pulled over.If not then nothings really changed. It's quite simple really.
The only thing you should be doing behind the wheel of a car is DRIVING.
Let's see less texting, phone calls*, smoking, eating, drinking, reading, and not to mention the "something on the passenger seat" which seems to distract around 99% of ladies when they stop at traffic lights.
* As Mr T would say, quit that jibber jabber, foo'.

I found it strange they banned handheld mobile phone usage and not smoking.
With a mobile phone, the distraction is the conversation not holind a tiny piece of plastic. With smoking, you have to open a packet or tin, manoevre a delicate object from it, then set fire to it. Then you have to hold it, on fire, until you need to dispose of it.
If ever there was an object that presented a hazard whilst driving, I'd say a cigarette was higher up the list than many things.

I can't see how they this won't be followed up. Last week (?timing) someone was convicted for touching their bluetooth earpiece. Smoking takes up much more hand-time.
Really it's always been illegal...there is no allowance for you to take your hands away from your driving activity in any way, only a quick scratch is allowable to effect driver relief otherwise you should stop.
So
changing gear = ok
changing radio station = stop the car.

Can anyone point to where this may have happened ANYTIME in the UK. In 35 years of driving I have never heard of such an incident. I think most sensible people will disregard this further infingement on our freedoms. If not then nothings really changed. Well Gorgon will be calling a snap election by all accounts shortly he will get his answer then I imagine

Cheers
I'm not against people smoking in the car or using a phone in some circumstances and agree this has become a nanny state. The accidents from smoking or phoning are insignificant imo. Hospitals and kitchens are far more dangerous places to be but untaxable. Give labour the boot. I've had enough of them telling me what I can and can't do and how much it's going to cost me.
It boil down to CONCENTRATION on road ahead.
It a "should".. not a "must"!
What I not understand.. only 11ke them cyclists sign petition over helmet.cycle lane law.. it get dropped.
we talk of just 11K vote here. It make drivers seem puerile here.
I never saw such a petition over the new 29 rules/.
I think it worth a mention that whole EU issue revised Highway Code at same time. I have copies of many EU revised codes from visit to HQ last week. (Kittens well cared for by the way
)
I think it worth mentioning that EU revisions focus on stopping distances und all COAST skills for all on the road including cyclists und pedestrians. I buy all these last week on visit to HQ und my parents. There thus a difference in focus which perhaps explain why KSO reduce faster on continent now ..
