Let's say someone gets pulled by the BiB, while fiddling with their mobile phone.


In actual fact they're pressing the button to hear the direction again on their satnav software on their phone, so they're not actually using the phone to call/text someone.

Would this stand up in court, and the offender can escape the 3 point charge?

If it's handheld they would get done. If it's on a holder they wouldn't, unless the coppers feel they are distracted by it.
