Yesterday my daughter discovered a hidden camera in the girls bathroom of her shared house at uni. She was able to remove it and identify the male housemate who placed it there. It looks like the camera had been there for several days and had videos on it of the girls using the bathroom etc. She called the police who arrived promptly

The police have been and arrested the male housemate, confiscated his IT and taken statements from the girls. The pervert has now been charged and released on bail.

Obviously his stuff is in the house and there is no way anyone wants him back there to collect it,

So some questions:

1. Will he be permitted back to the house, even if its just to collect his stuff? Do we need to look at something like an injunction to keep him away?
2. If he is prosecuted will it be magistrates court or crown court.
3. What are the likely punishments?
4. Should we report this to the Uni, he has had access to bathroom etc on campus and in halls
5. If the videos have found their way onto the internet, is there a way to firstly check and secondly have the removed. Particularly worried that they may have been shared on social media
6. What's the best way to support my daughter and her female friends? Will the police offer counselling?

All this is made worse because my daughter is legally a vulnerable person and suffers from anxiety which is no much worse

You'll have to ask the uni authorities about that, no one here can answer that question.

Presumably the uni authorities already know about it if the Police were called and he was arrested.

Of course if this "shared house at uni" is not actually "at uni" and is a private dwellinghouse outside of the university, then, yes, you should report it. But I'll bet they already know about it.

Sorry - should have been clear, daughter shares house with other uni students but it is off campus and owned by a private landlord

Christ, there are some sick fking perverts out there. Not much to add other than sympathy to the OP and his daughter. And definitely make sure the uni is aware.

They should get evicted at the bare minimum, what a fking creep.

I’ve just signed the tenancy agreement for my sons student accommodation for September, there’s a clause saying if he causes offence or abuse to anyone living or visiting he’d be evicted. I’d like to hope that’s a fairly common clause.

He must be able to collect his belongings, however, it is how this is implemented that is important. Accompanied by local police would probably be best.

Yes

However this individual claims to identify a girl so wants to use girls bathrooms (still stands up to piss though!)

If its anything like the student accommodation my 2 boys had I doubt the luxury of 2 bathrooms !
That case appears pretty similar doesn't it so have highlighted the pertinent part re telling Uni -in case they are unaware OP.
As to letting him back to collect his things I guess a question for the Police perhaps ?


"Any student who wishes to raise concerns about the conduct of another student or member of staff can do so in confidence by contacting our Student Support Centre. Confidential advice is also available through the Students' Union.
'The University has robust policies in place to deal with inappropriate behaviour including disciplinary action where appropriate."

Just read that is very similar indeed, except instead of a phone this was a camera that could be switched on and off and set to video or stills using bluetooth.

I think we will notify the Uni formally

1 - If he has been released on bail, he’ll have conditions not to have contact directly or indirectly (get a friend to message) the victims or witnesses most likely. He should also have one not to attend the address. It’s the most common conditions to have. You’re daughter can give the police a ring/email and ask them to confirm the bail conditions.

2 - I’d imagine it’s Voyeurism he’s been arrested for. This is an either way offence. It could be heard at either. I’d imagine it will be mags unless he has previous and they believe that their sentencing powers aren’t strong enough.

3 - Up to two years in prison is the most. For reference I arrested someone off duty who was taking photos up a women’s skirt just after upskirting become an offence in itself. He got a suspended sentence and/or unpaid work. Plus on the sex offenders register for five years I think.

4 - In my opinion yes. They will be able to offer support to your daughter and others.

5 - It’s very unlikely he’s uploading them. From previous experience it’s for his own use. If it’s been uploaded it’s another offence (possible revenge porn). You can request from the website for it to be removed. The big porn sites (PornHub etc) will do it with no issues…the smaller dodgier sites I’m not sure about.

6 - Be there for her. She’ll have a range of emotions. They will all be normal ones to have. The police won’t offer counselling, but can refer her to victim support. They will guide her through the process. Explain to them that she is vulnerable and she’ll be entitled to an enhanced service.

I hope that helps. It won’t be a quick investigation sadly. His IT stuff will need to be examined and takes a while sadly.

Might be tricky seeing as these are all allegations only at the moment. Unless he confesses to the Uni.

Indeed. I'd imagine there's also a safeguarding issue with other students. I can't imagine it would be great publicity for the Uni if he were to have any further inappropriate behaviour against another student, and the OPs daughters scenario came to light as disregarded.

Also, what is he studying? If, for example, medicine the GMC will want to know and will quash his career before it's started.

They very much will be interested in the conduct of one of their pupils especially with the kind offence committed

They probably will be. Student disciplinary policy will reference it.

e.g. "Any student, any other member of the University community, or a member of public may report an instance of misconduct. Such reports can be made to either a Student Discipline Officer or the Head of Student Discipline. If received by any other member of University staff the report will be forwarded appropriately or the reporting party signposted to the appropriate officer."

e.g. "Disciplinary action may be taken in relation to misconduct which happens off-campus during activities such as field trips and placements, or other placement organisations, or on social media, or where it affects the reputation of the University in the community."

This was from Brighton, but all Unis will have this in place. There is then an escalation and appeal process that works it's way up to the University Secretary and in most cases also allow an appeal including the University Executive Board.

(I was a trustee of one of the largest Universities in the UK and I sat on staff appeals, but not students)

This is spot on.

Your daughter needs to clarify any bail conditions he may have, he will have them but she needs to know exactly what they are.

Sounds like a nightmare, I've actually arrested someone in exactly the same circumstances years ago. He was step dad...cameras in the air bricks in the bedrooms and bathrooms the step daughters used. A horrible, gammy little prick of a man.

He got 4 years from memory and placed on the register but there were other additional offences based on the content of his harddrive....

Thank god it's been found, I can well imagine the contents of other electronic devices will be interesting.
