If he was blaitently ragging around leaving it on all the time, I am not surprised he got caught!!!
If, upon being warned, he had slowed down and turned it off and allowed them to get a reading, he would have got away with it AND kept his license!

The legislation on the use of these is ROUGHLY as follows ( Madcop etc will be more precise no doubt)
It is NOT Illegal to Buy, sell or posses a Jammer or detector. BUT they are illegal to use on the grounds of
Jammer - It emits an unlicensed signal (under some old Radio Emitions law) and the use of it - eg jamming the signal or confusing a Legal positioned device is (as has been stated in the article) perverting or attempting to pervert the course or justice.
Detector is illegal under the Radio Telegraphy Act ( or something similar) as you are illegaly recieving signals.
Road Angel, Morpheous and Origin Blue are NOT illegal as they work via the GPS system and notify the driver of an upcoming accident blackspot - The government advised police forces and councils that the Camera's should only be placed at accident blackspots - yeah right.

The laser jammers are exempt from the radio telegraphy act as they are emitting light. That is not illegal. The only offense they could do someone for is "perverting the course of justice".
Of course it would not surprise me if the police made illegal all form of light transmission. Therefore my headlights would have to be locked up and tried in a court of law.

Spot on. Light ( is an unregulated product, and can never be regulated.... (think about it!). In fact, anything with a frequency between 3x10^9 to 3*10^20 would have rather serious issues with being regulated (big yellow thing in the sky.....)

If you notice the article said that he was charged under "perverting the course of justice". To that end he's bang to rights and hasn't a leg to stand on as that is clearly what he was doing.

I think we have been over this before. I remember John Robson psoting on the facts of Perverting Justice.
This offence is very serious and carries 7 years in Jail (Archer got 4 of those). It is normally used to deal with people that are caught out telling porkies to get away with something or gain something without actually going to court and perjuring themselves in the witness box too.
Archer was convicted not only on the basis he perjured himself in the box but the outcome of his perjury gained him a substantial damages payout from the accused in his case. He perverted the justice which would otherwise have found his lible unfounded.
Usually, the offence used to deal with interfering with speed trap readings or the speed traps themselves (such as large notices before the trap advertising its position and that is was in operation) would be 'Obstruction of Police in execution of duty'.
I would imagine that because this chap was deemed to be actively employing a system to purposefully demonstrate his ability to avoid prosecution, that the officer stopping him, used the offence of Perverting Justice to justify his arrest. Obstruction of Police has no power of arrest unless it is used in conjunction with the General Power under Sect 25 PACE 1984 (he told them he was Mickey Mouse).
I would be interested to see if CPS pursue a charge of Perverting Justice over Obstruction of Police.
Perverting Juctice is an indictable offence (Crown Court only and very expensive).

I don't think so as the arrest was lawful. I have seen worse and thinner arrests using Sect 25 PACE than that. The only time bollockings arise is if the Chief Constable gets sued and loses.

I wouldn't be too sure, especially as he was said to have admitted the use to avaoid capture. We may see some new case law as a result on 'Obstructing Police'
RADAR detectors are not illegal as you are not recieveing and/or decoding the transmitted signal, merely detecting its presence. LASER diffusers aren't illegal as they only transmit IR. What are they going to do...? Ban every domestic appliance with a remote control...? RADAR Jammers are illegal as you can't transmit RADAR frequencies unlicenced. (most common K-band is 24GHz or something IIRC)
The guy in the article was frankly being a tit. I have an SLD920 and if you get shot, you slow down and turn it off pronto. Three strikes and you're out perhaps...? This guy was taking the proverbial and shafting all of us with these devices. Arresting him and charging with perverting the cause of justice is possibly a bit harsh, but then again, he was being a berk. Scary though how in this case a simple motoring offence got rapidly converted into a very serious criminal offence...
