Xbox 360 scratches game disk...and it's Forza 2!

Ok, now I'm well chuffed off.
Had my 360 since launch - it's always been located horizontally and hasn't moved from beneath the TV since I got it.
Playing Forza earlier and during the loading of a race, I got the "dirty disk" message. Checked out the game disc and it's well and truely borked (circular scratches all around it).
Any idea where I stand with this - obviously the console is out of warranty, but the game was brand new and hadn't been out of the drive since I received it on thursday and had been working fine.
Now the disk will load, but many of the races will crash out with the "dirty disk" error again.
Feel like I've completely wasted £40 and I'm very sceptical of trying anymore disks in the 360.

When the 360 first came out my housemate moved the 360 and scratched the disc, we looked in the manual (call of duty) and on the last page it said if you send back a scratched disc to them within 30 days of purchase they will send yoy a new one free.
I've looked and forza doesn't seem to offer this

Forza's been getting scratched regularly in mine over the weekend. No other game has ever caused me any problems to date, and the '360 hasn't moved an inch.
I wonder if the pressing is slightly too thick, unbalanced or something?
FWIW, a quick light rubbing with toothpaste under running water de-scratches the DVD quite admirably
Superb game, and well worth forking out for the wheel too.

Christ on a bike! Self-destructing Xboxes and now scratched disks too? What next? Sounds like Microsoft cut a few corners on the manufacturer to keep costs down and now they are paying for them!
If I was thinking about one though, are there any batches which are newer and hence not prone to these problems? Have they been fixed?
