Looking for some recommendations for a divorce lawyer for my sister in the Aberdeen area.

As I understand it, she's entitled to around £320k settlement from her husband in a 50/50 split of assets and pensions, after 20 years of marriage.

Current solicitor she is using has recommended she settles for £220k settlement, the difference mainly coming from my sister surrendering £100k of pension rights.

I am happy to fund her court cases, which would probably take a year, rather than see her lose out on a bunch of pension which is rightfully hers and would like to find a good solicitor who would take the fight to her husband.

Would welcome any suggestions.

Is there a reason you need toughest rather than fairest?

Why are you confident your calculations are correct and the lawyer's wrong?

I'm looking for someone who will get her what she's due.....that should also be fairest, but the current guy she's using seems to think she should settle for less because it's easier.

In my opinion, a few months of pain at the moment would be worth it to secure a 50/50 split of their assets, which is an additional 100k. These assets are basically house and pensions, so it's not like she's taking stuff like cars etc that she's not contributed to over the years.

She's kind of torn between wanting it settled as quickly as possible and getting the best deal possible. She wants rid of the guy, but as there's kids involved, she knows he's not going to disappear as soon as the settlement is made. She also realises that the additional 100k pension could make a massive difference to her in later life.

I know she is your sister and you want the best for her but I find it quite distasteful these things always come down to how much you can screw the other person for.

I'd never let myself get in a situation like marriage but I like to think I wouldn't then waste my time grabbing whatever I could. Move of, have a bit of pride and morality.

I know guys that have contributed pretty much everything financially to the length of the marriage. Their wife came in with next to nothing, still contributed next to nothing and come out the other side very well.

The husband always seems to be the real loser.

Why should someone who contributes far less than their share be entitled to so much and also so much of pensions which are no longer relevant?

I'd confidently bet the OP would be trying to protect himself if his wife was trying to get every penny out of him.

I can see this getting messy and the kids being piggy in the middles.

Divorce is such an unfair system.

What's the weather like up there? Looking down on the rest of us must be fun for you. Without knowing the reasons, I'll reserve judgement and let them sort it ou fairly like the OP suggests. I don't suppose it's tasteful for envy one who needs to through a divorce?

Fair enough, but I doubt anyone will be happy with the outcome. Especially when there's kids.

You also need to consider the least upheaval if kids involved, so sometimes quickest may be best, no easy solution, hope it gets sorted relatively painlessly, but not normally the case once lawyers get involved.

The children need to be the top priority. Ending this without making them see mum and dad tear each other apart over some money must be the main focus here.

OP it's easy to get carried away but this isn't your fight. Going by the length of the marriage your sister is presumably big enough to manage this without your involvement?

I agree it's distasteful, but the driver for this attitude has come from the husband. He continually threatens to go to court with his financially better off parents paying for his costs, and saying that my sister will become bankrupt by taking the fight to him.
