I'm being sued over my wedge accident.

I just got a call today from the lady who ilegally changed lanes mid intersection and clipped my wedge. She's suing ME for damages even tho IMHO she's at fault.
I'm sorry, I know this is my biz, my worries and not yours, but it was a kick in the nuts learning this and I had to vent some despair.
I had to get it off my chest and tell someone, it's been driving me bonkers all day.

Yes but that is sane England not crazy US.Did you not claim off her in the 1st place for the repairs, may look like if you did not clam then why.

I know exactly how you feel I also felt the need to rant to anyone I could.
Wish I could offer some reassurance but unfortunately not. A few months ago a young lad was waiting in the middle of a junction to turn right across my path at some notorious lights near me. The lights were on green for me as I got near him he decided to turn across my path and wrote my car off.
1 Police turn up and he tells them he was waiting at the lights they turned green and he went across junction and hits me. Policeman takes a look at the lights and says his story does not stack up. He has another think about it and changes his story to the fact that he did proceed past his green light to wait in the middle to turn.
2 It is his step mums car he is only 18 and they forgot to get it MOT’ed so policeman gave him a telling of and an on the spot fine.
3 The traffic light officer for the council confirms to me that it was virtually impossible for it to be my fault and he would be willing to appear in court if necessary to confirm this.
4 They totally change the lights and priorities so you have to wait until the arrow turns green before turning right. You can no longer proceed past the light to wait in the middle before turning right.They put signs everywhere to advise you of this so what happened to me cannot happen again.
Despite this 2 weeks later I get a very threatening letter letter from the other parties “no win no fee” lawyers saying pay up now or they are going to take me to court for failing to give way to him at the junction. They will also be sending their client to a doctors for a medical examination and will be claiming for injuries. Also loss of earnings and apparently his beat up old fiesta with no current mot is worth £2000.
Now my solicitor informs me it will probably end up 50/50 and I will loose my 30 year no claim free bonus, never felt the need to protect it before.
So my advice if you feel an accident really isn’t your fault is to get as many witnesses as you can.
If it is your fault, get out blame the other party as loudly as you can in front of witness’s and employ the nastiest most unscrupulous no win no fee bunch of cowboy lawyers you can find. Unfortunatly, I know some I can recommend, I wish I could employ them but they are representing the lad who hit me.

My wife had a run-in wih a fire engine, they wanted to go 50/50.
After a lot of research on my part (the lawyers weren't much use really apart from writing on letterheaded notepaper) I proved the point and we got a full payout.
So my advice it to stand your ground, and gather as much evidence as possible to support your case. No doubt this is a malicious action to make you back down. It's the usual tactic from a threatened party.
