Not sure if I should ask here or in legal but

Been doing agency work for a company for over a year now, get paid a contract flat rate weather the job takes 5 hours or 15, they don't do a time sheet.

However having problems getting paid for a day. Was booked for three days via the agency, day one I worked as normal, was told I was not needed day two, but when I did not go in i checked my phone and had a lot of phone calls and texts demanding to know where I am, I went in five hours late. Day three I got a text asking me to go in later than I was booked, I did, sat around for three hours and was sent home as I was not needed. I was then asked to work on day four.

Now I got paid for day one and four as normal, day two I will get paid this week apperently, but the company say they have no record of me going in, so agency doesn't want to pay me?

How do I deal with this, I have been asking the agency to pay me for six weeks they mostly ignored me. I threatened to report them to the registering body, I forget the name, they now took an interest

I don't want to fall out with then as the job is easy, pays OK and is a short distance from home

Regardless of the rights\wrongs of it, do you want to force the issue and gain a day's pay but lose the contract? Sucks I know, but it may be better to just step back and think of the bigger picture.

Probably the best middle ground is to make sure you know how your attendance is recorded, and make sure it is on any day you show up.

As to the texts, maybe take it up with whoever sent those.

I work through a limited co.

As for loosing the work, last October they reduced my pay without telling me, although they increased it again in December. In May I stopped working for them for a couple of weeks when they put me on an hourly rate.

Sounds like you are doing things a bit too informally.

When you are told to go home or not come in - dont just do it. Compose a very brief email to your direct report at the agency saying you are stood down early or sent home , time, date and location and who has sent you home.

Also, I would consider doing your own time sheet. Are you driving? Any tacho records if yes.
I think there are app that allow you to record working time, location etc all fairly easily with one press "arrived at work" and then another "break / left work" type of thing.

I would prefer written time sheets - but thats me.

As for getting paid, I would not force the issue if you have a long work history and you are happy otherwise. But I would make sure it does not happen again in the future by keeping more accurate records. As you are paid per day regardless of time worked then its quite simple to manage the records.
