As said .
Daughter is at present on maternity leave after presenting me with a four pound 15 grandson ( after a cesarean) ,due to problems .
First month she gets her payment .
Second month , she gets text to say that firm has had computer problems. Now a fortnight later she has no wages .Union has sent letter threatening action for breach of contract . Now exactly who pays maternity pay , and who to contact in the whole mass of Govt - that's her problem .

Anyone help ????

The employer alone is responsible for paying maternity pay, not the government. However, the employer can subsequently claim around 90% of the payment back from the government.

First
Instead of the union sending threatening letters how about demonstrating those much vaunted communication skills that women claim they have and talk, nicely and constructively, with her employer.

Second
Has she checked what the problem is? A "computer" problem could be anything from one PC in HR to a massive loss of records or sensitive data. Does she know what the problem is? Is the company in serious trouble? Can she help by offering to get HER records back on the system?

Third
If she continues to demand rights and send threats while the company is in crisis then she'll soon have no job to claim any money from. If HR are in a bad mood you can bet that any future reference will have "Failed to act constructively in a time of crisis" written on it.

Fourth
You are now going to involve some government department? This is very unlikely to help!

Start off by phoning up the company and find out what the problem was, and if she's got any workmates there see if they were paid.
Chances are someone has chimped putting her onto mat leave on her payroll system. They should be able to correct this through weekly pays.
(In fact many places pay maternity pay weekly anyway).

Slight O/T but what happens to maternity pay if the company goes bust whilst the recipient is still "off"?

I would imagine you'd have to head down to the Job Centre and sign up for Maternity Allowance. Much the same as if you've not been working long enough or earning enough to be entitled to Statutory Maternity Pay.

Thanks for replies ,BUT --


This is not the first time that she or any of her workmates have not been paid on time - hence the union's resort to legal measures for breach of contract .She and others are still waiting for repayment of bank charges from previous occurrences of non payment of wages on due dates .This firm has a history of non payment , waiting till impending legal action to pay suppliers.
So ,when maternity payments are government guaranteed - how does an employee go about getting paid . If she was a single mother ,with no partner - oh yes the state would rush in to stop her having to having to be a burden .But she's not .She's paid her way - and now what help is she entitled to . Folk can say -"Why involve a union " - but when a firm starts to shaft a vulnerable employee ,what other option do they have .
