maternity pay and sabbaticals
Discussion
You say she is still employed by them, but is she, or does she just have a guarrantee of being reemployed? If she is still being paid then she is still employed, but if she is unpaid then there is every likelihood that she is not currently employed by them. It's one of those situations where more information is required.

shes due in jan so wil be working oct - whenever u have to go off will this be enough?
Still not enough, you have to have been employed by the same employer continuously for at least 26 weeks into the 15th week before the week your baby is due (the qualifying week) I will use this as an example as dates are similar, my Granddaughter was born in Jan 2010 and my daughter just missed out on SMP, she started her job mid April 2009.
She was entitled to Maternity Allowance from the government though as she had worked enough weeks overall(Just not for the same employer.)
