Folks.

My wife is intending to resign her current position ASAP. She has a notice period of 1 week. She works 4 days a week and would like to know:

a) bank holidays are considered as working days in relation to a notice period and;
b) whether she can hand in her notice on a bank holiday.

Thanks very much in advance.

As to b - Who is she going to hand in her notice period to on a bank holiday ?

If the relevant post/role/department is staffed, then no reason why it cannot be done.

It's not clear if her employer will be in on the bank holiday. She's finding out this week. So, if the company director is available, theoretically she could hand it in to him even if it is a bank holiday?

I definitely don't see any reason why it cannot be handed in on that day. But I am not a lawyer.

If she is supposed to work on the bank holidays, then that should also counted for the notice period. I have no idea whether they would be counted for the notice period if she was not supposed to work on those days.

If the contract only mentions, one week, and nothing more specific, then I think it should just be one week from the day the notice was handed in, bank holiday or not.

I am sure someone better versed in employment law will be along shortly to give a more authoritative answer.

I've found something on DirectGov which suggests that notice starts the day after you hand it in. So, as she is not expected to work bank holidays, if she handed her notice in on the Friday before, would that mean that the week's notice would conclude on the following Friday regardless of the bank holidays? It's a bit unclear. :-)

As fer her contract, she doesn't have one. She has worked for the employer for over 10 years and it is customary for other employees to give 1 weeks notice.

Cheers for the reply.
