E60 M5 Private buyer looking to purchase from Private seller
Discussion
You can get one and the buy the Mondial warranty from www.bmw-warranty.co.uk If the car is properly serviced by BMW or a specialist. Its worth buying a monthly one as it works out cheaper and if the owner already has warranty on the car is my well be even cheaper. As soon as it is over 60k miles the warranty would jump in premium if paying annually.
No age limit, just mileage and FSH, since your looking for a low miler it should have FSH and getting a warranty should be fine.
Have a look at the buying guide for lots of info...

The usual caveats apply when purchasing a E60 M5. Don't judge a car on age or mileage... it's condition, condition, condition.
A low number of owners is a good sign, but people tend to keep these cars a short time due to the running costs so don't be put off if it's not a one owner car.
Go and see a few... maybe starting with a BMW AUC car and don't forget independent garages. Great if you can find a cherished one from a private owner... an encouraging sign is if they have the BMW warranty already. It indicates the car has been looked after and no maintenance corners have been cut. The BMW warranty is also transferable.
Hope that helps.

I was convinced I wanted simliar to you but an M6, until I started looking. The variation in quality is huge, just because a car was cheap/dear, AUC/Indie/private meant absolutely nothing and each car had to be viewed on it's own merit. I ended up buying a car with just over 60k on it as it's condition and fsh was fantastic compared to the others and had nearly all original paint, which not many have....
Thanks all for all valuable comments, most useful.. I guess i feel a touch more relaxed about going private re being able to get warranty if not already in place. Obviously a BMW main dealer would be the ideal place to buy fom but as mentioned earlier there seems to be a few really nice low mileage cars advertised privately.
Have seen an early car 55 reg with 16k that looks a 'peach' - worth viewing me thinks!!

Check its had all its recalls and that its on the later SMG software and pump. Also make sure its not that dodgy grey one that popped up for auction a few months back.Have seen an early car 55 reg with 16k that looks a 'peach' - worth viewing me thinks!!
Went to view one today. Early car 2005 in black had very good service history, main dealer every year sometimes twice then last two visits to independent. Owner suggested no problems ever but did have recall re gearbox software. It was a very nice - original paint only a few marks re stone chips and the odd swirl in the clear coat..
Only reason did not shake hands was price - Still it may still come in time but will keep looking..I am happy to pay very strong money for the right M5 trouble is I am ULTRA fussy and am looking for something that might not surface for a long time (Factory original with obcene low miles) but there is know rush..
Have opened my horizon on colour but favourite in order
Black
Inter blue
Silver
Silverstone
Weird colours
One thing I was suprised with was the box, did not feel that bad to me?? Having owned every previous M5 model the E60 gearbox has always held me back from going for one..Better than I thought!! Other observation was slightly disappointed with interior, read somewhere needs all the leather it can get. I have to agree with just minimum hide it did feel slightly low rent but my last car was an Audi RS6 Plus (c5) so I guess I have been spoilt!

It gets a bad press... started by one Messrs Clarkson who everyone believes! There seems quite a few good private examples knocking about at the moment but prices do seem firm. I reckon prices will remain firm for good low mileage examples as "that V10" means it'll be a car on many peoples bucket list.
This one looks a bit of a steal:
