Just out for one of my regular drives to the petrol station in the E61 earlier, stopped waiting to get on to a roundabout, at the back of a queue of around 6 cars.
Suddenly, *bang*
A guy in a Saxo VTR has "locked his brakes up trying to stop" and gone into the back of me
Damage doesn't look too bad, back bumper is still the right shape etc. but has some paint missing, scratches and some of his paint on it.
Thing I'm concerned about is the Eisenmann exhaust I only recently put on. The brackets holding the right-hand pipes up have been knocked off their retainers by the looks and the pipe is hanging down towards the road. Worried the pipe may have been damaged.

Sh!t---sorry, even if not your fault!
The same thing happened to me a while ago. I did not have Eisenmann exhausts but the bracket detached and the pipes on the driver side hung loose. The brackets can easily be welded and the rubber can be replaced. From the photo, I don't see a physical damage (dent) on the pipes?
I guess the other driver's insurer will repair your car: hit from the back, admission of fault can't be yours! Even if your insurer insist on stock exhaust per standard cover(?????), it still won't be difficult to sort re-attach the pipes.

Yeah, declared them as soon as they were fitted - although I declared them to my broker rather than the insurance company itself, so hopefully they passed it on.
Lady at the claims dept. for the insurance company that I spoke to yesterday asked me if the car was modified, and I disclosed it then anyway.
Other guy is insured, the police confirmed that for me at the scene (no injuries, but I called them to inform them of the debris in the road and they sent a unit out just to make sure everything was alright!)

The OP's insurer has nothing to do with this. OP will claim off the Saxo drivers insurance. (Assumes Saxo driver has cover and will admit fault.)Schermerhorn said:

Shouldn't make a difference. He is not claiming on his policy.
Had same concerns when someone wrote of a bike I had with an upgraded system. Thier assessor looked at it and valued it accordingly.

He probably will end up claiming on his policy when the other bloke claims that the M5 swerved in front of him and he couldn't avoid hitting it though... The M5 was collected this morning by a recovery truck to be taken to my local BMW dealer for assessment and repair. Upsettingly, despite me asking the recovery guy (not BMW, but a local recovery company) to be careful with the exhaust to avoid scraping it on the road, he scraped it all along the road while going up the ramp (as the back end dropped down when the car started going up the ramp)
So hopefully he's not done any damage to it.
Just after he left, the courtesy car turned up. A white 13-plate 640i. Initial impressions (just the short drive to work) are that it's got a fair bit of grunt, but rear visibility is terrible and the car feels about 4 feet wider than the M5 - I'm attributing this to wider door cards or something.

Really? I thought it was always considered the fault of the guy behind if you hit someone up the arse - no exceptions basically?

I'm 18 months into a disputed claim where someone hit me in the rear in a line of traffic. You'd think it'd be straightforward, but they claim that I changed lanes abruptly in front of them, so in the absence of other witnesses it might end up 50/50.Good luck OP I hope it all gets sorted as quickly as possible.
This is precisely why I've ordered a dash cam today. Luckily I've never been in a situation like you but I don't want to risk it.

LOL--"M5 reversed into a Saxo"---classic! Yes, you make a good point, it happened to a friend of mine, the other driver had witnesses in the car but my friend did not!!! Which camera are you thinking of getting? The ones I've see for the E60 M5 means you would need to remove the number plate frame to install it. Those on the bumpers stick out a bit.Naturally this all happens weeks later and you've no witnesses because you thought it was an open and shut case of someone going into the back of you. Front and rear camera are top of my list when my car arrives!
Gaz, You did the right thing by declaring the modification and you also had the police as a witness. Nothing to worry about, the other driver's insurer will replace the Eisenmann pipes if damaged---BUT ask your insurer to ensure that the Eisenmann (not stock) is what should be ordered. Otherwise it could lead to delays. Normally the cops don't come out if no injuries---well done with the 'debris on the road' report. Did your insurer increase your premium when you reported the modification or are you not at renewal yet? Also, that irritating question: 'have you had an accident in the past 5yrs even if not your fault'---your no NCB can be protected but hope they won't increase your premium even in not your fault.

Hopefully this helps a few people out! I was going to go for the BlackVue DR550 but the higher speed pixelation is putting me off. The Mini 0801 looks the best buy if you don't want any extra functionality such as Wifi connectivity, iPhone/iOS App, front & rear recording.
My big big big concern is the installation. I'd preferably get it done by the guys who do the trackers for my BMW garage.....if only I could get their details!!!
