Daughter has just bought a house and has asked for the vendor to remove the currently fitted stairlift. Vendor is adamant that this will not be removed as this may cause damage to the property. Not sure if I am accepting this as a stairlift is a temporary fixture and not required by the purchaser.
Regardless of what her reasoning is, what is the legal position here?

I can't believe this is even a question. Really not worth getting your knickers in a twist about.

If she’s already bought the property I can’t see what she can do. This should be been dealt with prior to exchange of contracts.

I'd want to remove it myself to make sure its done properly, with minimal damage, and not 'ripped out' by the vendor.

I don't see how they could be forced to remove it. Either the sale goes through or it doesn't. Different if it was listed as part of the sale then removed by the seller.

I believe there are companies that resell second hand systems so maybe ask if they would remove it for free?

Yup. Getting the buying and the negotiating in the wrong order.

might help.

If is like the stairlift in Mamma-FGs house the rail is simply 4 brackets screwed to the steps on the stairs. Nothing attached to the wall, about 30mins to remove.

Buy a cat and train them to ride the stairs like an emporer for lols?

If they have bough the house, this is too late to ask for work to be done. It should have been in the contract.

If she is in the process of buying, then she has a simple choice. Either buy it or walk away.

I have some sympathy for the vendor here. Removing a stair lift could leave damage, and someone who is asking for it removed is likely a buyer who will also expect perfection and no holes in the wall...

There was one in Dad's house, i just rang the people who fitted it, he had it away in less than half an hour.

I could have done it myself, but then what to do with, might as well give it away than hire a skip or van.

May be useful logging stuff upstairs in the short term, but then look for companies that buy 2nd hand stair lifts. We had one for my MIL which we sold after she passed away, you won't get much for it 100-200 quid but they'll come and remove without any damage (depending upon the install), took less than an hour for us.

She's bought a house with a stairlift. I don't understand why it would be the vendor's problem.

If she didn’t negotiate the removal as part of the purchase the legal position is she now owns a stairlift.

My first house had one installed which was removed prior to the house being sold to me, only issue was I had to get the hallway and stairs reskimmed because there were marks from the installation, not a massive deal in the grand scheme of things

Presumably you (your daughter) pre-exchange? You have the right to request it removed, the vendor has the right to say no, temporary fixture or not. They are absolutely right to refuse IMO.

Now you have to choose what to do next. Walk or continue to buy and remove it yourself once you own the place.

Has she exchanged, but a condition of the completion is to remove the stairlift?

So is the question what happend when a condition of the sale is not performed between exchange and completion?

Thank you so much for that site, we're in the process of buying a house with a stairlift and were wondering if there was a second hand market for them!
